  1 An Act relating to the collection, transportation, and disposal
  2    of household hazardous waste.
  3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 455F.8A, Code 2005, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  3.  A private agency which provides for
  1  4 the collection and disposal of household hazardous waste as
  1  5 part of an approved comprehensive plan pursuant to section
  1  6 455B.306 shall be eligible for reimbursement moneys pursuant
  1  7 to section 455E.11, subsection 2, paragraph "a", subparagraph
  1  8 (2), subparagraph subdivision (d).
  1  9    Sec. 2.  Section 455E.11, subsection 2, paragraph a,
  1 10 subparagraph (2), subparagraph subdivision (d), Code 2005, is
  1 11 amended to read as follows:
  1 12    (d)  Nine For the fiscal year beginning July 1, 2005, nine
  1 13 and one=half percent to the department to establish permanent
  1 14 household hazardous waste collection sites so that both urban
  1 15 and rural populations are served and so that collection
  1 16 services are available to the public on a regular basis.
  1 17 Beginning July 1, 2006, six and one=quarter percent to the
  1 18 department to establish permanent household hazardous waste
  1 19 collection sites so that both urban and rural populations are
  1 20 served and so that collection services are available to the
  1 21 public on a regular basis.  Beginning July 1, 2007, three
  1 22 percent to the department to establish permanent household
  1 23 hazardous waste collection sites so that both urban and rural
  1 24 populations are served and so that collection services are
  1 25 available to the public on a regular basis.  Any moneys
  1 26 collected pursuant to this subparagraph subdivision that
  1 27 remain unexpended at the end of a fiscal year for
  1 28 establishment of permanent household hazardous waste
  1 29 collection sites shall be used for purposes of subparagraph
  1 30 subdivision (e).
  1 31    Sec. 3.  Section 455E.11, subsection 2, paragraph a,
  1 32 subparagraph (2), subparagraph subdivision (e), Code 2005, is
  1 33 amended to read as follows:
  1 34    (e)  Three For the fiscal year beginning July 1, 2005,
  1 35 three percent to the department for payment of transportation
  2  1 costs related to household hazardous waste collection
  2  2 programs.  Beginning July 1, 2006, six and one=quarter percent
  2  3 to the department for payment of transportation costs related
  2  4 to household hazardous waste collection programs.  Beginning
  2  5 July 1, 2007, nine and one=half percent to the department for
  2  6 payment of transportation costs related to household hazardous
  2  7 waste collection programs.
  2  8                           EXPLANATION
  2  9    This bill relates to the collection, transportation, and
  2 10 disposal of household hazardous waste.
  2 11    The bill provides that a private agency which provides for
  2 12 the collection and disposal of household hazardous waste as
  2 13 part of an approved comprehensive plan may use a portion of
  2 14 solid waste tonnage fees for the establishment of permanent
  2 15 household hazardous waste collection sites.
  2 16    Currently, 9.5 percent of the tonnage fees deposited in the
  2 17 solid waste account of the groundwater protection fund are
  2 18 used by the department to establish permanent household
  2 19 hazardous waste collection sites.  The bill provides that, for
  2 20 the fiscal year beginning July 1, 2006, the percentage
  2 21 decreases to 6.5 percent and for the fiscal period beginning
  2 22 July 1, 2007, and every fiscal year thereafter, the percentage
  2 23 decreases to 3 percent.  The bill provides that any moneys
  2 24 remaining unexpended at the end of a fiscal year shall be used
  2 25 for payment of transportation costs related to household
  2 26 hazardous waste collection programs.
  2 27    Currently, 3 percent of the tonnage fees deposited in the
  2 28 solid waste account of the groundwater protection fund are
  2 29 used by the department for payment of transportation costs
  2 30 related to household hazardous waste collection programs.  The
  2 31 bill provides that, for the fiscal year beginning July 1,
  2 32 2006, the percentage increases to 6.5 percent and for the
  2 33 fiscal period beginning July 1, 2007, and every fiscal year
  2 34 thereafter, the percentage increases to 9.5 percent.
