  1 An Act to require rate=regulated electric utilities to purchase a
  2    minimum amount of alternate energy and providing an effective
  3    date.

  1  1    Section 1.  Section 476.43, subsection 1, paragraph a, Code
  1  2 2005, is amended by adding the following new unnumbered
  1  3 paragraph:
  1  4    NEW UNNUMBERED PARAGRAPH.  To meet the requirements of this
  1  5 paragraph "a", an electric utility, except a utility that
  1  6 elects rate regulation pursuant to section 476.1A, shall
  1  7 purchase or generate at least fifteen percent of the utility's
  1  8 total annual Iowa retail electric sales from alternate energy
  1  9 production facilities or small hydro facilities at the rates
  1 10 established pursuant to this section.
  1 11    Sec. 2.  Section 476.44, subsection 2, Code 2005, is
  1 12 amended by striking the subsection.
  1 13    Sec. 3.  EFFECTIVE DATE.  This Act takes effect January 1,
  1 14 2012.
  1 15                           EXPLANATION
  1 16    This bill requires all electric utilities whose rates are
  1 17 regulated by the Iowa utilities board of the department of
  1 18 commerce pursuant to Code chapter 476 to purchase or generate
  1 19 a minimum of 15 percent of the utility's total annual retail
  1 20 electric sales in Iowa from alternate energy production
  1 21 facilities or small hydro facilities.  "Alternate energy
  1 22 production facility" and "small hydro facility" are defined in
  1 23 Code section 476.42.  The alternate energy purchased shall be
  1 24 purchased at the rates established by the Iowa utilities board
  1 25 pursuant to Code section 476.43.  The bill eliminates the
  1 26 provision providing that rate=regulated electric utilities be
  1 27 required to purchase no more than a share of 150 megawatts of
  1 28 power from alternate energy production facilities or small
  1 29 hydro facilities.
  1 30    The bill takes effect January 1, 2012.
