1 An Act establishing a new bicycle user fee and making an
2 appropriation.

1 1 Section 1. Section 465B.4, Code 2005, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 4. Fees collected from the sale of new
1 4 bicycles under section 465B.5 for the purpose of bicycle trail
1 5 maintenance.
1 6 Sec. 2. NEW SECTION. 465B.5 NEW BICYCLE USER FEE.
1 7 1. A fee of five dollars is imposed on the sale of every
1 8 new bicycle, other than a device which is designed and
1 9 intended by the manufacturer for use by a child under twelve
1 10 years of age, sold in this state by a retailer. The fee shall
1 11 be paid to the retailer at the time of purchase of the
1 12 bicycle. The retailer shall remit monthly to the department
1 13 such fees collected during the previous month.
1 14 2. Fees collected under this section are appropriated to
1 15 the department to be used statewide for maintenance projects
1 16 for recreational trails designed for bicycle use.
1 17 3. For purposes of this section, the following definitions
1 18 apply:
1 19 a. "Bicycle" means a device having two wheels and at least
1 20 one saddle or seat for the use of a rider and which is
1 21 propelled by human power.
1 22 b. "Department" means the state department of
1 23 transportation.
1 24 c. "Retailer" means a person who sells new bicycles
1 25 directly to consumers in this state.
1 26 4. The department shall adopt rules as necessary to
1 27 accomplish the purposes of this section.
1 28 EXPLANATION
1 29 This bill imposes a user fee of $5 on new bicycles
1 30 purchased in this state. The fee is to be paid by the
1 31 purchaser to the retailer at the time of purchase. Retailers
1 32 are required to remit fees collected on a monthly basis to the
1 33 department. The fees are to be used for bicycle trail
1 34 maintenance projects statewide.
1 35 The bill exempts bicycles intended by the manufacturer for
2 1 use by children under 12 years of age from the user fee
2 2 requirement.
