  1  1    Section 1.  NEW SECTION.  135C.49  PORTION OF PENALTIES
  1  2 APPROPRIATED == DIRECT CARE WORKER RECRUITMENT AND RETENTION.
  1  3    1.  Notwithstanding any provision of this chapter to the
  1  4 contrary, ten percent of the civil penalties collected from
  1  5 health care facilities for violations of this chapter,
  1  6 annually, are appropriated to the Iowa department of public
  1  7 health to be used for efforts to recruit and retain direct
  1  8 care workers that provide services in both facility=based and
  1  9 community=based settings.  The Iowa department of public
  1 10 health may contract with an organization that serves direct
  1 11 care workers to implement such efforts.
  1 12    2.  For the purposes of this section, "direct care workers"
  1 13 includes but is not limited to certified nursing assistants,
  1 14 home health aides, homemaker aides, patient care technicians,
  1 15 resident assistants, direct support staff, personal care
  1 16 attendants, hospice aides, medication aides, rehabilitation
  1 17 aides, adult day care workers, and assisted living personnel.
  1 18                           EXPLANATION
  1 19    This bill provides that notwithstanding any provision to
  1 20 the contrary, 10 percent of the civil penalties collected from
  1 21 health care facilities for violations of the health care
  1 22 facilities chapter (Code chapter 135C), annually, are
  1 23 appropriated to the Iowa department of public health to be
  1 24 used for efforts to recruit and retain direct care workers
  1 25 that provide services in both facility=based and community=
  1 26 based settings.  The bill provides that the Iowa department of
  1 27 public health may contract with an organization that serves
  1 28 direct care workers to implement the efforts.
