  1  1    Section 1.  Section 135.11, subsection 29, Code 2005, is
  1  2 amended to read as follows:
  1  3    29.  Administer annual grants to county boards of health
  1  4 for the purpose of conducting programs for the testing of
  1  5 private water supply wells, the closing of abandoned private
  1  6 water supply wells, and the renovation or rehabilitation of
  1  7 private water supply wells.  Grants shall be funded through
  1  8 moneys transferred to the department from the agriculture
  1  9 management account of the groundwater protection fund pursuant
  1 10 to section 455E.11, subsection 2, paragraph "b", subparagraph
  1 11 (3), subparagraph subdivision (b).  The department shall adopt
  1 12 rules relating to the awarding of the grants.  A grant
  1 13 recipient shall be required to include testing for arsenic
  1 14 whenever testing is conducted on private water supply wells.
  1 15                           EXPLANATION
  1 16    This bill relates to testing private water supply wells for
  1 17 arsenic.
  1 18    Currently, the department of public health administers an
  1 19 annual grant program for purposes of providing grants to
  1 20 county boards of health for the purpose of conducting programs
  1 21 for the testing of private water supply wells, the closing of
  1 22 abandoned private water supply wells, and the renovation or
  1 23 rehabilitation of private water supply wells.  The bill
  1 24 requires that a grant recipient shall be required to include
  1 25 testing for arsenic whenever testing is conducted on private
  1 26 water supply wells.
