  1  1    Section 1.  NEW SECTION.  279.60  HEALTHY STUDENT BODY
  1  2 REQUIREMENTS.
  1  3    1.  The board of directors of each public school shall
  1  4 prohibit elementary school student access to vending machines
  1  5 offering food and beverages in school district attendance
  1  6 centers.
  1  7    2.  The board of directors of each public school shall do
  1  8 all of the following:
  1  9    a.  Include, as part of the progress report submitted to
  1 10 the local community pursuant to section 256.7, subsection 21,
  1 11 paragraph "c", the amounts and specific sources of funds
  1 12 received and expenditures made by the school district from
  1 13 competitive food and beverage contracts, broken down by
  1 14 attendance center if any such contract applies to or benefits
  1 15 a particular attendance center.
  1 16    b.  Require schools to annually send to the parent or
  1 17 guardian of a student a student health report that includes a
  1 18 body mass index percentile by age for the student.  The
  1 19 determination of a student's body mass index shall be done
  1 20 with regard for the privacy of the student in a location at
  1 21 the school in which other persons are not present.  The report
  1 22 shall also include an explanation of the possible health
  1 23 effects related to body mass index, nutrition, and physical
  1 24 activity.
  1 25    3.  A student shall be excused from the determination of
  1 26 the body mass index percentile provided for under subsection 2
  1 27 if the student's parent or guardian files with the school
  1 28 principal a written request that the pupil be excused.
  1 29    Sec. 2.  STATE MANDATE FUNDING SPECIFIED.  In accordance
  1 30 with section 25B.2, subsection 3, the state cost of requiring
  1 31 compliance with any state mandate included in this Act shall
  1 32 be paid by a school district from state school foundation aid
  1 33 received by the school district under section 257.16.  This
  1 34 specification of the payment of the state cost shall be deemed
  1 35 to meet all the state mandate funding=related requirements of
  2  1 section 25B.2, subsection 3, and no additional state funding
  2  2 shall be necessary for the full implementation of this Act by
  2  3 and enforcement of this Act against all affected school
  2  4 districts.
  2  5                           EXPLANATION
  2  6    This bill requires the board of directors of each public
  2  7 school to prohibit elementary school student access to vending
  2  8 machines offering food and beverages in attendance centers; to
  2  9 include, as part of an academic progress report that the Code
  2 10 requires each school district to annually submit to the
  2 11 community, the amounts and specific sources of funds received
  2 12 and expenditures made by the school district from competitive
  2 13 food and beverage contracts; to send annually to a student's
  2 14 parent or guardian a student health report that includes a
  2 15 body mass index (BMI) percentile by age for the student and an
  2 16 explanation of the possible health effects relating to body
  2 17 mass index, nutrition, and physical activity.
  2 18    The determination of a student's BMI must be done with
  2 19 regard for the student's privacy, and the student shall be
  2 20 excused from BMI determination if the student's parent or
  2 21 guardian files with the school principal a written request
  2 22 that the pupil be excused.
  2 23    The bill may include a state mandate as defined in Code
  2 24 section 25B.3.  The bill requires that the state cost of any
  2 25 state mandate included in the bill be paid by a school
  2 26 district from state school foundation aid received by the
  2 27 school district under Code section 257.16.  The specification
  2 28 is deemed to constitute state compliance with any state
  2 29 mandate funding=related requirements of Code section 25B.2.
  2 30 The inclusion of this specification is intended to reinstate
  2 31 the requirement of political subdivisions to comply with any
  2 32 state mandates included in the bill.
