1 An Act relating to motor vehicle registration fees for certain
2 motor trucks and making an appropriation.

1 1 Section 1. Section 321.109, subsection 1, unnumbered
1 2 paragraph 1, Code 2005, is amended to read as follows:
1 3 The annual fee for all motor vehicles including vehicles
1 4 designated by manufacturers as station wagons, and 1993 and
1 5 subsequent model years for multipurpose vehicles, except motor
1 6 trucks with an unladen weight exceeding seven thousand five
1 7 hundred pounds, special trucks, motor homes, ambulances,
1 8 hearses, motorcycles, motor bicycles, and 1992 and older model
1 9 years for multipurpose vehicles, shall be equal to one percent
1 10 of the value as fixed by the department plus forty cents for
1 11 each one hundred pounds or fraction thereof of weight of
1 12 vehicle, as fixed by the department. The weight of a motor
1 13 vehicle, fixed by the department for registration purposes,
1 14 shall include the weight of a battery, heater, bumpers, spare
1 15 tire, and wheel. Provided, however, that for any new vehicle
1 16 purchased in this state by a nonresident for removal to the
1 17 nonresident's state of residence the purchaser may make
1 18 application to the county treasurer in the county of purchase
1 19 for a transit plate for which a fee of ten dollars shall be
1 20 paid. And provided, however, that for any used vehicle held
1 21 by a registered dealer and not currently registered in this
1 22 state, or for any vehicle held by an individual and currently
1 23 registered in this state, when purchased in this state by a
1 24 nonresident for removal to the nonresident's state of
1 25 residence, the purchaser may make application to the county
1 26 treasurer in the county of purchase for a transit plate for
1 27 which a fee of three dollars shall be paid. The county
1 28 treasurer shall issue a nontransferable certificate of
1 29 registration for which no refund shall be allowed; and the
1 30 transit plates shall be void thirty days after issuance. Such
1 31 purchaser may apply for a certificate of title by surrendering
1 32 the manufacturer's or importer's certificate or certificate of
1 33 title, duly assigned as provided in this chapter. In this
1 34 event, the treasurer in the county of purchase shall, when
1 35 satisfied with the genuineness and regularity of the
2 1 application, and upon payment of a fee of ten dollars, issue a
2 2 certificate of title in the name and address of the
2 3 nonresident purchaser delivering the same to the person
2 4 entitled to the title as provided in this chapter. The
2 5 application requirements of section 321.20 apply to a title
2 6 issued as provided in this subsection, except that a natural
2 7 person who applies for a certificate of title shall provide
2 8 either the person's social security number, passport number,
2 9 or driver's license number, whether the license was issued by
2 10 this state, another state, or another country. The provisions
2 11 of this subsection relating to multipurpose vehicles are
2 12 effective January 1, 1993, for all 1993 and subsequent model
2 13 years. The annual registration fee for multipurpose vehicles
2 14 that are 1992 model years and older shall be in accordance
2 15 with section 321.124.
2 16 Sec. 2. Section 321.122, subsection 1, unnumbered
2 17 paragraph 1, Code 2005, is amended to read as follows:
2 18 The annual registration fee for truck tractors, road
2 19 tractors, and motor trucks with an unladen weight exceeding
2 20 seven thousand five hundred pounds, except motor trucks
2 21 registered as special trucks, shall be based on the combined
2 22 gross weight of the vehicle or combination of vehicles. All
2 23 such trucks, truck tractors, or road tractors shall be
2 24 registered for a gross weight equal to or in excess of the
2 25 unladen weight of the vehicle or combination of vehicles. The
2 26 annual registration fee fees for such vehicles or combination
2 27 of vehicles, except special trucks, shall be are as follows:
2 28 Sec. 3. Section 321.122, subsection 1, paragraph a, Code
2 29 2005, is amended by striking the paragraph.
2 30 Sec. 4. NEW SECTION. 321.122A APPROPRIATION == SCHOOL
2 31 TRANSPORTATION.
2 32 Beginning in January 2006, the department shall calculate
2 33 monthly, from the total fees received from the registration of
2 34 motor trucks under section 321.109, the amount that is in
2 35 excess of the amount that would have been received for
3 1 registration of those same motor trucks under section 321.122,
3 2 Code 2005. Notwithstanding section 423.43, and prior to the
3 3 crediting of revenues to the road use tax fund under section
3 4 423.43, subsection 1, paragraph "b", the treasurer of state
3 5 shall transfer monthly from those revenues to the general fund
3 6 of the state the amount of excess registration fees calculated
3 7 under this section and collected in the previous month. The
3 8 moneys so transferred are appropriated to the department of
3 9 education for support of the school transportation system.
3 10 Notwithstanding section 8.33, moneys transferred and
3 11 appropriated under this section shall not revert to the
3 12 general fund of the state.
3 13 Sec. 5. APPLICABILITY. This Act applies to new and
3 14 renewal registrations of motor trucks with an unladen weight
3 15 of seven thousand five hundred pounds or less for registration
3 16 years beginning on or after January 1, 2006.
3 17 EXPLANATION
3 18 This bill revises the method for calculating annual
3 19 registration fees for motor trucks with an unladen weight of
3 20 7,500 pounds or less. Currently, most such trucks are
3 21 registered based on combined gross weight for an annual fee of
3 22 $65, which is reduced to $55 when the vehicle is more than 10
3 23 model years old, $45 when the vehicle is more than 13 model
3 24 years old, and $35 when the vehicle is more than 15 model
3 25 years old.
3 26 The bill requires that for registration years beginning on
3 27 or after January 1, 2006, motor trucks with an unladen weight
3 28 of 7,500 pounds or less shall be registered under the weight
3 29 and value system that applies to most other motor vehicles.
3 30 Currently under that system, registration fees are equal to 1
3 31 percent of the value of the vehicle plus 40 cents for each 100
3 32 pounds of weight of the vehicle. Registration fees based on
3 33 weight and value are automatically reduced according to the
3 34 age of the vehicle beginning when the vehicle is more than
3 35 five model years old.
4 1 The bill directs the state department of transportation to
4 2 calculate monthly the excess revenues derived from registering
4 3 motor trucks with an unladen weight of 7,500 pounds or less
4 4 under the weight and value fee system rather than the current
4 5 flat fee system. The excess revenues are appropriated to the
4 6 department of education, from motor vehicle use tax revenues,
4 7 for support of the school transportation system.
