Section 321.20B, subsection 4, Code 2005, is 1 2 amended by adding the following new paragraph: 1 3 NEW PARAGRAPH. d. Notwithstanding section 805.8A, 1 4 subsection 14, paragraph "f", an owner or driver who admits to 1 5 or is convicted of a violation of subsection 1, and who 1 6 produces to the clerk of court within thirty days of the date 1 7 of conviction, proof of financial liability coverage, shall 1 8 have the fine imposed reduced to twenty=five dollars, or if 1 9 the violation is in connection with a motor vehicle accident, 1 10 to one hundred seventy=five dollars. Upon payment of the fine 1 11 to the clerk of court of the county where the citation was 1 12 issued, payment of a fifteen dollar administrative fee to the 1 13 county treasurer of the county in which the motor vehicle is 1 14 registered, and providing proof of payment of the applicable 1 15 fine and proof of financial liability coverage to the county 1 16 treasurer of the county in which the motor vehicle is 1 17 registered, the treasurer shall issue new license plates and 1 18 registration to the owner. 1 19 Sec. 2. Section 805.8A, subsection 14, paragraph f, Code 1 20 2005, is amended to read as follows: 1 21 f. PROOF OF FINANCIAL RESPONSIBILITY.IfExcept as 1 22 provided in section 321.20B, if, in connection with a motor 1 23 vehicle accident, a person is charged and found guilty of a 1 24 violation of section 321.20B, subsection 1, the scheduled fine 1 25 is five hundred dollars; otherwise, the scheduled fine for a 1 26 violation of section 321.20B, subsection 1, is two hundred 1 27 fifty dollars. Notwithstanding section 805.12, fines 1 28 collected pursuant to this paragraph shall be submitted to the 1 29 state court administrator and distributed fifty percent to the 1 30 victim compensation fund established in section 915.94, 1 31 twenty=five percent to the county in which such fine is 1 32 imposed, and twenty=five percent to the general fund of the 1 33 state. 1 34 EXPLANATION 1 35 This bill relates to fines that are imposed for driving 2 1 without financial liability coverage. The bill provides that, 2 2 notwithstanding the scheduled fines for this violation that 2 3 are contained in Code section 805.8A, subsection 14, paragraph 2 4 "f", an owner or driver who admits to or is convicted of this 2 5 violation and who provides proof that the person has obtained 2 6 financial liability coverage within 30 days of the date of 2 7 conviction shall have the fine payable reduced to $25, or to 2 8 $175 if the violation is in connection with a motor vehicle 2 9 accident. If the owner provides proof of payment of the 2 10 applicable fine and proof of financial liability coverage and 2 11 pays a $15 administrative fee to the county treasurer of the 2 12 county in which the motor vehicle is registered, the treasurer 2 13 shall issue new license plates and registration to the owner. 2 14 Currently, a person who admits to or is found guilty of a 2 15 violation of the financial liability coverage requirements is 2 16 subject to a scheduled fine of $250 or of $500, if the 2 17 violation occurs in connection with a motor vehicle accident. 2 18 LSB 2833HH 81 2 19 av:nh/pj/5
