  1  1    Section 1.  HEALTHY IOWANS TOBACCO TRUST == APPROPRIATION
  1  2 TO IOWA DEPARTMENT OF PUBLIC HEALTH.  There is appropriated
  1  3 from the healthy Iowans tobacco trust created in section 12.65
  1  4 to the Iowa department of public health for the fiscal year
  1  5 beginning July 1, 2005, and ending June 30, 2006, the
  1  6 following amount, or so much thereof as is necessary, to be
  1  7 used for the purposes designated:
  1  8    For the tobacco use prevention and control initiative,
  1  9 including efforts at the state and local levels, as provided
  1 10 in chapter 142A:
  1 11 .................................................. $ 19,300,000
  1 12    1.  The director of public health shall dedicate sufficient
  1 13 resources to promote and ensure retailer compliance with
  1 14 tobacco laws and ordinances relating to persons under 18 years
  1 15 of age, and shall prioritize the state's compliance in the
  1 16 allocation of available funds to comply with 42 U.S.C. } 300x=
  1 17 26 and section 453A.2.
  1 18    2.  Of the amount appropriated in this section, a portion
  1 19 of the amount shall be utilized to provide for enforcement of
  1 20 tobacco laws, regulations, and ordinances under a chapter 28D
  1 21 agreement entered into between the Iowa department of public
  1 22 health and the alcoholic beverages division of the department
  1 23 of commerce.
  1 24    3.  Of the funds appropriated in this section, not more
  1 25 than $525,759 shall be expended on administration and
  1 26 management of the initiative.
  1 27    4.  Of the funds appropriated in this section, not less
  1 28 than 80 percent of the amount expended in the fiscal year
  1 29 beginning July 1, 2001, for community partnerships shall be
  1 30 expended in the fiscal year beginning July 1, 2005, for that
  1 31 purpose.
  1 32                           EXPLANATION
  1 33    This bill appropriates moneys from the healthy Iowans
  1 34 tobacco trust to the Iowa department of public health for
  1 35 tobacco use prevention and control, including efforts at the
  2  1 state and local levels.  The bill also directs the director of
  2  2 public health to dedicate sufficient resources to promote and
  2  3 ensure retailer compliance with tobacco laws and ordinances
  2  4 relating to persons under 18 years of age, and to prioritize
  2  5 the state's compliance in the allocation of available funds;
  2  6 allows that a portion of the amount appropriated is to be
  2  7 utilized to provide for enforcement of tobacco laws,
  2  8 regulations, and ordinances under a Code chapter 28D agreement
  2  9 entered into between the Iowa department of public health and
  2 10 the alcoholic beverages division of the department of
  2 11 commerce; limits the amount of moneys appropriated to be used
  2 12 for administration of the program; and provides that of the
  2 13 amount appropriated, not less than 80 percent of the amount
  2 14 expended in the fiscal year beginning July 1, 2001, for
  2 15 community partnerships is to be expended in the fiscal year
  2 16 beginning July 1, 2005, for that purpose.
