  1  1    Section 1.  NEW SECTION.  481C.4  DEER DEPREDATION PERMITS
  1  2 == RESTRICTIONS == PENALTY.
  1  3    1.  Notwithstanding section 481C.2, a landowner who incurs
  1  4 crop or nursery damage caused by deer population may apply to
  1  5 the county recorder for not more than ten deer depredation
  1  6 permits for each farm unit of eighty acres where the damage
  1  7 has occurred.  The department shall specify, by rule, a
  1  8 proportional number of permits which may be issued without a
  1  9 fee for farm units based on the size of the farm unit, damage
  1 10 done, and deer population.  The application shall specify the
  1 11 crops or nursery stock damaged, the estimated amount of
  1 12 damage, and the area of the farm unit where the damage
  1 13 occurred.  The permit is valid only from September 1 through
  1 14 the succeeding March 1 for taking an antlerless deer only on
  1 15 the farm unit specified on the application.  If additional
  1 16 deer depredation damage occurs after ten deer have been taken
  1 17 on a farm unit, not more than ten additional depredation
  1 18 permits for taking an antlerless deer only may be issued
  1 19 without a fee with the approval of a representative of the
  1 20 department.  A postcard shall be issued with each depredation
  1 21 permit.  A person taking a deer with the depredation permit
  1 22 shall complete and return the postcard to the county recorder
  1 23 within ten days after taking the deer.  An unused depredation
  1 24 permit and postcard shall be returned to the county recorder
  1 25 by March 10 following the expiration of the depredation
  1 26 permit.
  1 27    2.  A landowner who has been issued a deer depredation
  1 28 permit pursuant to subsection 1 may give the deer depredation
  1 29 permit to hunt on the specified farm unit to any person who is
  1 30 otherwise licensed, except for a deer license, to hunt in this
  1 31 state.  If a deer depredation permit is used by any person
  1 32 other than the landowner, the name and address of the user
  1 33 shall be legibly written on the permit and on the return
  1 34 postcard.
  1 35    3.  Except during a regular shotgun season, any bow and
  2  1 arrow or any legal firearm may be used to take a deer with a
  2  2 deer depredation permit.
  2  3    4.  A person who violates this section or a rule adopted
  2  4 under this section is guilty of a simple misdemeanor which is
  2  5 punishable as a scheduled violation under section 805.8B,
  2  6 subsection 3, paragraph "e".
  2  7    Sec. 2.  Section 805.8B, subsection 3, paragraph e, Code
  2  8 2005, is amended to read as follows:
  2  9    e.  For violations of sections 481A.57, 481A.85, 481A.93,
  2 10 481A.95, 481A.120, 481A.137, 481B.5, 481C.4, 482.3, 482.9,
  2 11 482.15, and 483A.42, the scheduled fine is one hundred
  2 12 dollars.
  2 13                           EXPLANATION
  2 14    This bill authorizes the owner of a farm unit which has
  2 15 incurred crop or nursery damage caused by deer population to
  2 16 apply to the county recorder for not more than 10 deer
  2 17 depredation permits for each farm unit of 80 acres where the
  2 18 damage has occurred.  The department shall specify, by rule, a
  2 19 proportional number of depredation permits which may be issued
  2 20 without fee for farm units of varying size.  The application
  2 21 shall specify the crops or nursery stock damaged, the
  2 22 estimated amount of damage, and the area of the farm unit
  2 23 where the damage occurred.  Each depredation permit is valid
  2 24 only from September 1 through the succeeding March 1 for
  2 25 taking an antlerless deer only on the farm unit specified on
  2 26 the permit.  If additional damage occurs after 10 deer have
  2 27 been taken on a farm unit, not more than 10 additional
  2 28 antlerless deer only depredation permits may be issued with
  2 29 the approval of a representative of the department of natural
  2 30 resources without fee.  A postcard shall be issued with each
  2 31 depredation permit which shall be completed and returned by
  2 32 the hunter within 10 days after taking a deer.  An unused
  2 33 depredation permit and postcard shall be returned to the
  2 34 county recorder by March 10.
  2 35    A landowner who has been issued a deer depredation permit
  3  1 may give the permit to hunt on the landowner's farm unit to
  3  2 any person who is otherwise licensed, except for a deer
  3  3 license, to hunt in this state.  If a deer depredation permit
  3  4 is used by any person other than the owner of the farm unit,
  3  5 the name and address of the user shall be legibly written on
  3  6 the permit and on the return postcard.
  3  7    Except during a regular shotgun season, any bow and arrow
  3  8 or other legal firearm may be used to take deer with a deer
  3  9 depredation permit.
  3 10    A person violating the provisions of this section is guilty
  3 11 of a simple misdemeanor, which is punishable by a scheduled
  3 12 fine of $100.
