  1  1    Section 1.  Section 262.1, Code 2005, is amended by
  1  2 striking the section and inserting in lieu thereof the
  1  3 following:
  1  4    262.1  REGENTS == ELECTION == TERMS.
  1  5    The state board of regents consists of nine members, who
  1  6 shall be elected for terms of six years each, as follows:
  1  7    1.  At the general election held in 2006, and each six
  1  8 years thereafter, three regents shall be elected, one of whom
  1  9 shall be a qualified elector of, and elected by the qualified
  1 10 electors of, the first congressional district; one of whom
  1 11 shall be a qualified elector of, and elected by the qualified
  1 12 electors of, the fifth congressional district; and one of whom
  1 13 shall be a qualified elector of this state and elected at
  1 14 large by the qualified electors of this state.
  1 15    2.  At the general election held in 2008, and each six
  1 16 years thereafter, three regents shall be elected, one of whom
  1 17 shall be a qualified elector of, and elected by the qualified
  1 18 electors of, the second congressional district; one of whom
  1 19 shall be a qualified elector of, and elected by the qualified
  1 20 electors of, the fourth congressional district; and one of
  1 21 whom shall be a qualified elector of this state and elected at
  1 22 large by the qualified electors of this state.
  1 23    3.  At the general election held in 2010, and each six
  1 24 years thereafter, three regents shall be elected, one of whom
  1 25 shall be a qualified elector of, and elected by the qualified
  1 26 electors of, the third congressional district; and two of whom
  1 27 shall be qualified electors of this state and elected at large
  1 28 by the qualified electors of this state.
  1 29    Sec. 2.  Section 262.2, Code 2005, is amended by striking
  1 30 the section and inserting in lieu thereof the following:
  1 31    262.2  OATH OF REGENTS.
  1 32    Each member elected pursuant to section 262.1 or appointed
  1 33 pursuant to section 262.3 shall qualify by taking the oath of
  1 34 office as provided in section 63.10.  Such oath shall be
  1 35 properly verified by the administering officer and filed with
  2  1 the secretary of the board.
  2  2    Sec. 3.  NEW SECTION.  262.3  VACANCIES.
  2  3    The governor shall fill all vacancies that may occur in the
  2  4 state board of regents as provided in section 69.8, subsection
  2  5 2.  The individuals so appointed shall hold their offices
  2  6 until the next general election and until their successors are
  2  7 duly elected and duly qualified according to law.
  2  8    Sec. 4.  Sections 262.4 through 262.6, Code 2005, are
  2  9 repealed.
  2 10    Sec. 5.  TRANSITION PROVISIONS.  Appointed members of the
  2 11 state board of regents serving on the effective date of this
  2 12 Act shall continue to serve in office as follows:
  2 13    1.  A member whose term expires on April 30, 2007,
  2 14 appointed by the governor to the state board of regents shall
  2 15 continue in office until members are elected and sworn into
  2 16 office pursuant to section 262.1, subsection 1, as amended by
  2 17 this Act, at which time the term of the appointed member shall
  2 18 be terminated.
  2 19    2.  A member whose term expires on April 30, 2009,
  2 20 appointed by the governor to the state board of regents shall
  2 21 continue in office until members are elected and sworn into
  2 22 office pursuant to section 262.1, subsection 2, as amended by
  2 23 this Act, at which time the term of the appointed member shall
  2 24 be terminated.
  2 25    3.  A member whose term expires on April 30, 2011,
  2 26 appointed by the governor to the state board of regents shall
  2 27 continue in office until members are elected and sworn into
  2 28 office pursuant to section 262.1, subsection 3, as amended by
  2 29 this Act, at which time the term of the appointed member shall
  2 30 be terminated.
  2 31    Sec. 6.  EFFECTIVE DATE.  Sections 1 through 4 of this Act,
  2 32 amending sections 262.1 and 262.2, adding new section 262.3,
  2 33 and repealing sections 262.4 through 262.6, take effect July
  2 34 1, 2006.
  2 35                           EXPLANATION
  3  1    This bill provides for the election of the nine state board
  3  2 of regents members for six=year terms.
  3  3    Under the bill, members will be elected at the general
  3  4 elections as follows:
  3  5    1.  In 2006, and every six years thereafter, one member
  3  6 each from the third and fifth congressional districts and one
  3  7 at=large member.
  3  8    2.  In 2008, and every six years thereafter, one member
  3  9 each from the second and fourth congressional districts and
  3 10 one at=large member.
  3 11    3.  In 2010, and every six years thereafter, one member
  3 12 from the third congressional district and two at=large
  3 13 members.
  3 14    Each member qualifies by taking the oath of office.
  3 15 Vacancies are filled by the governor by individuals who will
  3 16 hold the office until the next general election when their
  3 17 successors are elected and take the oath of office.
  3 18    The bill repeals provisions related to the removal and
  3 19 suspension of members by the governor, and the filling of
  3 20 vacancies created by appointed members.
  3 21    The bill provides for the transition from an appointed to
  3 22 an elected board by providing that members appointed to terms
  3 23 ending in 2007 serve until replaced by the elected members in
  3 24 2006, members appointed to terms ending in 2009 serve until
  3 25 replaced by the elected members in 2008, and members appointed
  3 26 to terms ending in 2011 serve until replaced by the elected
  3 27 members in 2010.
  3 28    The transitional provisions take effect July 1, 2005, while
  3 29 the remainder of the bill takes effect July 1, 2006.
