Section 144.46, Code 2005, is amended to read 1 2 as follows: 1 3 144.46 FEE FOR COPY OF RECORD. 1 4 1.TheExcept as provided in subsection 2, the department 1 5 by rule shall establish fees based on the average 1 6 administrative cost which shall be collected by the state 1 7 registrar or the county registrar for each certified copy or 1 8 short form certification of certificates or records, or for a 1 9 search of the files or records when no copy is made, or when 1 10 no record is found on file. 1 11 2. The state registrar or the county registrar shall 1 12 charge a fee of fifteen dollars for the first certified copy 1 13 of a death certificate, and ten dollars for each additional 1 14 certified copy of a death certificate ordered at the same 1 15 time, which fees include the fees collected pursuant to 1 16 section 331.605, subsection 6. 1 17 3. Fees collected by the state registrar and by the county 1 18 registrar on behalf of the state under this section shall be 1 19 deposited in the general fund of the state. Fees collected by 1 20 the county registrar pursuant to section 331.605, subsection 1 21 6, shall be deposited in the county general fund. A fee shall 1 22 not be collected from a political subdivision or agency of 1 23 this state. 1 24 1 25 EXPLANATION 1 26 This bill provides that the state registrar or the county 1 27 registrar shall charge a fee of $15 for the first certified 1 28 copy of a death certificate, and $10 for each additional 1 29 certified copy of a death certificate ordered at the same 1 30 time. The bill specifically sets out these fees in a new 1 31 subsection of Code section 144.46, which more generally 1 32 provides that the Iowa department of public health shall 1 33 establish fees for copies of record by rule based on the 1 34 average administrative cost incurred by the state registrar or 1 35 county registrar. 2 1 Current provisions regarding the deposit of fees collected 2 2 by the state registrar and by the county registrar in the 2 3 general fund of the state, and deposit in the county general 2 4 fund of fees retained by the county registrar pursuant to Code 2 5 section 331.605, subsection 6, continue to be applicable to 2 6 certified copies of death certificates. 2 7 LSB 1632HH 81 2 8 rn:rj/pj/5.2
