1 An Act relating to the road use tax fund by allowing counties to
2 create a regional transportation board for secondary road
3 improvements and providing for allocations from the fund.

1 1 Section 1. Section 312.2, Code 2005, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 19. The treasurer of state, before making
1 4 the allotments provided for in this section, shall credit
1 5 annually for five years from the road use tax fund to a
1 6 regional transportation board created pursuant to section
1 7 312.2A an amount equal to fifteen percent of the revenues
1 8 generated in the region in the prior fiscal year and deposited
1 9 in the road use tax fund for road improvements and planning
1 10 pursuant to section 312.2A.
1 11 Sec. 2. NEW SECTION. 312.2A REGIONAL TRANSPORTATION
1 12 BOARD.
1 13 1. Two or more counties may enter into a chapter 28E
1 14 agreement to provide for the creation and establishment of a
1 15 regional transportation board. Each county board of
1 16 supervisors shall appoint members to the board as follows:
1 17 a. Two residents of the county.
1 18 b. One resident of the largest city in each county.
1 19 2. The board shall prepare a regional plan for secondary
1 20 road improvements. On or before January 1, 2006, and each
1 21 year thereafter, the board shall submit a report to the
1 22 department on the regional plan prepared under this section.
1 23 3. The board shall use the road use tax fund moneys
1 24 allocated to the board pursuant to section 312.2 for regional
1 25 secondary road planning and improvements.
1 26 EXPLANATION
1 27 This bill allows two or more counties to form a regional
1 28 transportation board to fund regional planning and
1 29 improvements for secondary roads. The county board of
1 30 supervisors appoints the board members, who represent both the
1 31 counties and the largest cities within the counties. The
1 32 board is required to submit an annual report on the regional
1 33 plan for road improvements to the department of
1 34 transportation.
1 35 The bill provides that prior to allocations in Code section
2 1 312.2, subsections 1 through 4, a regional transportation
2 2 board established pursuant to the bill will receive annually
2 3 for five years from the road use tax fund an amount equal to
2 4 15 percent of the revenues generated in the region in the
2 5 prior fiscal year and deposited in the road use tax fund.
