1 An Act relating to the temporary confinement of prisoners in the
2 custody of the federal government or the department of
3 corrections in a county jail.

1 1 Section 1. NEW SECTION. 331.658A FEDERAL PRISONERS.
1 2 The county may provide temporary confinement of a prisoner
1 3 in the custody of the federal government.
1 4 Sec. 2. Section 904.513, subsection 2, Code 2005, is
1 5 amended to read as follows:
1 6 2. Upon request by the director a county shall may provide
1 7 temporary confinement for offenders allegedly violating the
1 8 conditions of assignment to a program under this chapter, if
1 9 space is available in the county. The department shall
1 10 negotiate a reimbursement rate with each county. The amount
1 11 to be reimbursed shall be determined by multiplying the number
1 12 of days a person is confined by the average daily cost of
1 13 confining a person in the county facility as negotiated with
1 14 the department. A county holding offenders in jail due to
1 15 insufficient space in a community residential facility shall
1 16 be reimbursed. Payment shall be made upon submission of a
1 17 voucher executed by the sheriff and approved by the director.
1 18 Sec. 3. Section 904.908, subsection 1, Code 2005, is
1 19 amended to read as follows:
1 20 1. Upon request by the Iowa department of corrections, the
1 21 board of parole, or a judicial district department of
1 22 correctional services a county shall may provide temporary
1 23 confinement for alleged violators of work release conditions
1 24 if space is available.
1 25 Sec. 4. Section 906.17, subsection 1, Code 2005, is
1 26 amended to read as follows:
1 27 1. Upon request by the Iowa department of corrections a
1 28 county shall may provide temporary confinement for alleged
1 29 parole violators if space is available.
1 30 EXPLANATION
1 31 This bill relates to the temporary confinement of prisoners
1 32 in the custody of the federal government or the department of
1 33 corrections in a county jail.
1 34 The bill provides that a county may temporarily confine
1 35 prisoners in the custody of the federal government or the
2 1 department of corrections in the county jail. Current law
2 2 requires a county to temporarily confine prisoners in the
2 3 custody of the department of corrections under certain
2 4 circumstances.
