  1 An Act relating to information required to be provided and
  2    published relative to health care benefits provided through
  3    public funds or which are uncompensated and providing an
  4    effective date.

  1  1                       UNCOMPENSATED CARE
  1  2    Section 1.  NEW SECTION.  135M.1  PATIENT INFORMATION
  1  3 REQUIRED == UNCOMPENSATED CARE.
  1  4    1.  An individual who is the recipient of health care
  1  5 services in a hospital and is uninsured shall disclose to the
  1  6 hospital the identity of the employer of the proposed
  1  7 beneficiary of health care benefits.  If the proposed
  1  8 beneficiary of health care benefits is not employed, the
  1  9 individual shall identify the employer of any adult who is
  1 10 responsible for providing support to the proposed beneficiary.
  1 11    2.  On or before January 1, 2007, and on or before January
  1 12 1 annually thereafter, each hospital shall submit a report to
  1 13 the department of human services providing the information
  1 14 collected under subsection 1 in a compiled format.  The
  1 15 reports submitted shall be used by the department of human
  1 16 services to compile the report required pursuant to section
  1 17 217.30A.  The department of human services shall adopt rules
  1 18 regarding the form to be used and the information to be
  1 19 collected under subsection 1.  Information collected shall not
  1 20 include the name of any individual proposed beneficiary and
  1 21 shall be collected in a manner that complies with all privacy
  1 22 standards established by state or federal law.
  1 23    3.  For purposes of this section, "proposed beneficiary"
  1 24 means an individual who receives health care services in a
  1 25 hospital who is uninsured or the person on whose behalf the
  1 26 individual receives health care benefits through the hospital,
  1 27 including but not limited to a child or other dependent of the
  1 28 individual.
  1 29    Sec. 2.  NEW SECTION.  217.30A  REPORT ON HEALTH CARE
  1 30 BENEFICIARIES.
  1 31    1.  On or before January 15, 2007, and on or before each
  1 32 January 15 annually thereafter, the department of human
  1 33 services shall submit a report to the governor and the general
  1 34 assembly specifying all employers identified pursuant to
  1 35 sections 135M.1, 249A.3A, and 514I.12 that, combined, employ
  2  1 twenty=five or more proposed beneficiaries as defined in those
  2  2 sections.  In determining whether an employer meets the
  2  3 threshold of employing twenty=five or more proposed
  2  4 beneficiaries, the department of human services shall include
  2  5 all proposed beneficiaries employed by the employer and its
  2  6 subsidiaries at all locations within the state.  The report
  2  7 shall include the name of the employer, the location of the
  2  8 employer, and the total number of the employer's employees and
  2  9 dependents of employees who are proposed beneficiaries.  The
  2 10 report shall also include the total cost to the state for
  2 11 providing health care benefits to the employees and dependents
  2 12 of the employees of the employers identified.  The report
  2 13 shall not include the name of any individual proposed
  2 14 beneficiary and shall comply with all privacy standards
  2 15 established by state or federal law.  The report shall also be
  2 16 made available to the public.
  2 17    2.  The department of human services shall adopt rules
  2 18 pursuant to chapter 17A to implement this section.
  2 19    Sec. 3.  NEW SECTION.  249A.3A  APPLICANT INFORMATION
  2 20 REQUIRED == PUBLISHING INFORMATION.
  2 21    1.  An applicant for the medical assistance program shall
  2 22 disclose the identity of the employer of the proposed
  2 23 beneficiary of health care benefits.  If the proposed
  2 24 beneficiary is not employed, the applicant shall identify the
  2 25 employer of any adult who is responsible for providing support
  2 26 to the proposed beneficiary.
  2 27    2.  On or before January 1, 2007, and on or before January
  2 28 1 annually thereafter, the department shall compile the
  2 29 information collected under subsection 1.  The information
  2 30 compiled shall be used by the department of human services to
  2 31 compile the report required pursuant to section 217.30A.  The
  2 32 department of human services shall adopt rules regarding the
  2 33 form to be used and the information to be collected under
  2 34 subsection 1.  Information collected shall not include the
  2 35 name of any individual proposed beneficiary and shall be
  3  1 collected in a manner that complies with all privacy standards
  3  2 established by state or federal law.
  3  3    3.  For the purposes of this section, "proposed
  3  4 beneficiary" means an individual who files an application for
  3  5 medical assistance for the individual or the person on whose
  3  6 behalf the individual files an application, including but not
  3  7 limited to a child or other dependent of the applicant or
  3  8 other individual for whom the application is filed.
  3  9    Sec. 4.  NEW SECTION.  514I.12  APPLICANT INFORMATION
  3 10 REQUIRED == PUBLISHING INFORMATION.
  3 11    1.  An applicant for the hawk=i program shall disclose the
  3 12 identity of the employer of the proposed beneficiary of health
  3 13 care benefits.  If the proposed beneficiary is not employed,
  3 14 the applicant shall identify the employer of any adult who is
  3 15 responsible for providing support to the proposed beneficiary.
  3 16    2.  On or before January 1, 2007, and on or before January
  3 17 1 annually thereafter, the department shall compile the
  3 18 information collected under subsection 1.  The information
  3 19 submitted shall be used by the department of human services to

  3 32 other individual for whom the application is filed.
  3 33    Sec. 5.  EFFECTIVE DATE.  This Act takes effect January 1,
  3 34 2006.
  3 35                           EXPLANATION
  4  1    This bill requires individuals who are the recipients of
  4  2 health care services in a hospital and are uninsured to
  4  3 disclose the identity of the employer of the proposed
  4  4 beneficiary of health care benefits.  If the proposed
  4  5 beneficiary of health care benefits is not employed, the
  4  6 individual is required to identify the employer of any adult
  4  7 who is responsible for providing support to the proposed
  4  8 beneficiary.  The bill also requires that an applicant for the
  4  9 medical assistance program or the hawk=i program disclose the
  4 10 identity of the employer of the proposed beneficiary of health
  4 11 care benefits.  If the proposed beneficiary is not employed,
  4 12 the applicant is required to identify the employer of any
  4 13 adult who is responsible for providing support to the proposed
  4 14 beneficiary.  The required provision of information is to
  4 15 begin January 1, 2006.
  4 16    The bill provides that on or before January 1, 2007, and on
  4 17 or before January 1 annually thereafter, each hospital is
  4 18 required to compile the information submitted by individuals
  4 19 regarding employers and submit a report of this information to
  4 20 the department of human services.  Additionally, on or before
  4 21 January 1, 2007, and on or before January 1 annually
  4 22 thereafter, the information submitted by applicants for
  4 23 medical assistance or the hawk=i program regarding employers
  4 24 is to be compiled by the department of human services.
  4 25    The bill then provides that beginning January 15, 2007, and
  4 26 each January 15 annually thereafter, the department of human
  4 27 services is to submit a report to the governor and the general
  4 28 assembly specifying all employers identified by hospitals or
  4 29 the Medicaid or hawk=i programs that, combined, employ 25 or
  4 30 more proposed beneficiaries.  The report is to include the
  4 31 name of the employer, the location of the employer, and the
  4 32 total number of the employer's employees and dependents of
  4 33 employees who are proposed beneficiaries.  The report is also
  4 34 to include the total cost to the state for providing health
  4 35 care benefits to the employees and dependents of the employees
  5  1 of the employers identified.  The report is not to include the
  5  2 names of any individual proposed beneficiary and is also to
  5  3 comply with all privacy standards established by state or
  5  4 federal law.  The bill also provides that the report is to be
  5  5 made available to the public.
  5  6    The bill takes effect January 1, 2006.
