  1 An Act relating to policies establishing an additional
  2    classification for purposes of postsecondary tuition and fees
  3    paid at public institutions of higher education in this state.
  4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

  1  1    Section 1.  Section 260C.14, Code 2005, is amended by
  1  2 adding the following new subsection:
  1  3    NEW SUBSECTION.  21.  Adopt a policy, to take effect not
  1  4 later than January 1, 2006, relating to an additional
  1  5 classification of students for purposes of determining tuition
  1  6 and fees for individuals who meet all of the following
  1  7 conditions:
  1  8    a.  Attended an accredited high school in this state for at
  1  9 least three years as of the date the individual graduated from
  1 10 an accredited high school or received a high school
  1 11 equivalency diploma in this state.
  1 12    b.  Is accepted for enrollment in a community college in
  1 13 this state.
  1 14    c.  Was not required to pay tuition to attend a public high
  1 15 school in this state.
  1 16    d.  Signs an affidavit, if the individual does not have a
  1 17 social security number, stating that the individual will
  1 18 pursue citizenship in the United States at the earliest
  1 19 possible time the individual is able to do so.
  1 20    Sec. 2.  Section 262.9, Code 2005, is amended by adding the
  1 21 following new subsection:
  1 22    NEW SUBSECTION.  31.  Adopt a policy, to take effect not
  1 23 later than January 1, 2006, relating to an additional
  1 24 classification of students for purposes of determining tuition
  1 25 and fees for individuals who meet all of the following
  1 26 conditions:
  1 27    a.  Attended an accredited high school in this state for at
  1 28 least three years as of the date the individual graduated from
  1 29 an accredited high school or received a high school
  1 30 equivalency diploma in this state.
  1 31    b.  Is accepted for enrollment in a university under the
  1 32 control of the board in this state.
  1 33    c.  Was not required to pay tuition to attend a public high
  1 34 school in this state.
  1 35    d.  Signs an affidavit, if the individual does not have a
  2  1 social security number, stating that the individual will
  2  2 pursue citizenship in the United States at the earliest
  2  3 possible time the individual is able to do so.
  2  4                           EXPLANATION
  2  5    This bill directs the board of directors of a community
  2  6 college and the state board of regents to adopt policies, to
  2  7 take effect not later than January 1, 2006, relating to an
  2  8 additional classification of students for purposes of
  2  9 determining tuition and fees for individuals who attended an
  2 10 accredited high school in this state for at least three years
  2 11 or received a high school equivalency diploma in this state,
  2 12 are accepted for enrollment in a public postsecondary
  2 13 institution in this state, were not required to pay tuition to
  2 14 attend a public high school in this state, and who sign an
  2 15 affidavit stating that the individual will pursue U.S.
  2 16 citizenship at the earliest possible time the individual is
  2 17 able to do so.
