1 An Act providing for an increase in the amount of supplementary
2 weighting applicable to limited English proficient students,
3 and providing an effective date.

1 1 Section 1. Section 280.4, subsection 3, Code 2005, is
1 2 amended to read as follows:
1 3 3. In order to provide funds for the excess costs of
1 4 instruction of limited English proficient students above the
1 5 costs of instruction of pupils in a regular curriculum,
1 6 students identified as limited English proficient shall be
1 7 assigned an additional weighting of twenty=two thirty=two
1 8 hundredths, and that weighting shall be included in the
1 9 weighted enrollment of the school district of residence for a
1 10 period not exceeding three years. However, the school budget
1 11 review committee may grant supplemental aid or modified
1 12 allowable growth to a school district to continue funding a
1 13 program for students after the expiration of the three=year
1 14 period.
1 15 Sec. 2. EFFECTIVE DATE. This Act, being deemed of
1 16 immediate importance, takes effect upon enactment.
1 17 EXPLANATION
1 18 This bill increases the additional weighting assigned to
1 19 limited English proficient students under the school finance
1 20 formula from the current level of twenty=two hundredths to the
1 21 level of thirty=two hundredths. The effect of the additional
1 22 weighting is to count a limited English proficient student as
1 23 more than one student for purposes of determining enrollment
1 24 in a school district, which generates additional funding for
1 25 limited English proficient programs.
1 26 The bill takes effect upon enactment.
