1 An Act providing supplementary weighting for shared school
2 district operational functions, making an appropriation, and
3 providing effective and applicability dates.

1 1 Section 1. Section 257.11, Code 2005, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 5A. SHARED OPERATIONAL FUNCTIONS ==
1 4 INCREASED STUDENT OPPORTUNITIES.
1 5 a. In order to provide additional funding to increase
1 6 student opportunities for school districts that share
1 7 operational functions, a supplementary weighting plan for
1 8 determining enrollment is adopted. A supplementary weighting
1 9 of two hundredths per pupil shall be assigned to pupils
1 10 enrolled in a district that shares with one or more other
1 11 districts one or more operational functions in the areas of
1 12 business management, human resources, transportation, or
1 13 operation and maintenance for at least twenty percent of the
1 14 school year.
1 15 b. The minimum amount of additional weighting for which a
1 16 school district shall be eligible is an amount corresponding
1 17 to ten additional pupils, and the maximum amount of additional
1 18 weighting for which a school district shall be eligible is an
1 19 amount corresponding to twenty additional pupils. Criteria
1 20 for determining qualification of operational functions for
1 21 additional weighting shall be determined by the department of
1 22 education by rule.
1 23 c. Amounts received as supplementary weighting for sharing
1 24 operational functions pursuant to paragraph "a" and for any
1 25 savings realized through the sharing of such functions shall
1 26 be utilized by a school district to improve teacher salaries,
1 27 and offer additional courses to maximize the access of every
1 28 high school student to four years of mathematics, science, and
1 29 English or language arts, with the intent that additional
1 30 course offerings will include advanced content and advanced
1 31 placement opportunities.
1 32 Sec. 2. SHARED OPERATIONAL FUNCTIONS == SUPPLEMENTARY
1 33 WEIGHTING == APPROPRIATION. For the fiscal year beginning
1 34 July 1, 2005, and ending June 30, 2006, there is appropriated
1 35 from the general fund of the state to the department of
2 1 education the following amount, or so much thereof as may be
2 2 necessary, to be utilized for the purpose designated:

2 4 The funds appropriated pursuant to this section shall be
2 5 allocated on or about November 15, 2005, to school districts
2 6 that have established shared operational functions pursuant to
2 7 section 257.11, subsection 5A. If the amount appropriated is
2 8 insufficient to fully fund the amount of supplementary
2 9 weighting requested and approved, the funds shall be allocated
2 10 to each requesting and approved school district based on the
2 11 ratio that each district's actual enrollment bears to the
2 12 total actual enrollment of all requesting and approved school
2 13 districts. Notwithstanding section 8.33, moneys appropriated
2 14 in this section that remain unencumbered or unobligated at the
2 15 close of the fiscal year shall not revert but shall remain
2 16 available for expenditure for the purposes designated until
2 17 the close of the succeeding fiscal year.
2 18 Sec. 3. EFFECTIVE DATE. This Act, being deemed of
2 19 immediate importance, takes effect upon enactment, and first
2 20 applies to supplementary weighting for the school year
2 21 beginning July 1, 2005.
2 22 EXPLANATION
2 23 This bill provides for the establishment of a new category
2 24 of supplementary weighting relating to shared school
2 25 operational functions.
2 26 The bill provides that supplementary weighting shall be
2 27 available to increase student opportunities for school
2 28 districts that share operational functions. The bill provides
2 29 that a supplementary weighting of .02 per pupil shall be
2 30 assigned to pupils enrolled in a district that shares one or
2 31 more operational functions in the areas of business
2 32 management, human resources, transportation, or operation and
2 33 maintenance for a minimum of 20 percent of the school year.
2 34 The bill provides that the amounts received either as
2 35 supplementary weighting or any savings realized through the
3 1 sharing of operational functions shall be utilized by a school
3 2 district to improve teacher salaries, and offer additional
3 3 courses to maximize the access of every high school student to
3 4 four years of mathematics, science, and English or language
3 5 arts, with the intent that additional course offerings will
3 6 include advanced content and advanced placement opportunities.
3 7 The bill provides that the minimum amount of additional
3 8 weighting for which a school district shall be eligible is an
3 9 amount corresponding to 10 additional pupils, and the maximum
3 10 is an amount corresponding to 20 additional pupils. The bill
3 11 provides that criteria for determining qualification of
3 12 operational functions for additional weighting shall be
3 13 determined by the department of education by rule.
3 14 The bill appropriates $1.6 million from the state general
3 15 fund to the department of education to be allocated on or
3 16 about November 15, 2005, to school districts which have
3 17 established shared operational functions, provides for
3 18 nonreversion of the funds, and provides for allocation among
3 19 all requesting and approved school districts if the amount
3 20 appropriated is insufficient to fully fund the amounts
3 21 requested and approved based on the ratio that each requesting
3 22 and approved school district's actual enrollment bears to the
3 23 total actual enrollment of all requesting and approved school
3 24 districts.
3 25 The bill takes effect upon enactment and first applies to
3 26 supplementary weighting for the school year beginning July 1,
3 27 2005.
