1 An Act relating to information contained in applications for and
2 recorded on driver's licenses and nonoperator's identification
3 cards and providing an effective date.

1 1 Section 1. Section 321.182, subsection 1, paragraph a,
1 2 Code 2005, is amended to read as follows:
1 3 a. Make application on a form provided by the department
1 4 which shall include the applicant's full name, signature,
1 5 current mailing address, current residential address, date of
1 6 birth, social security number, and physical description
1 7 including sex, height, and eye color. The application form
1 8 shall also include space where the applicant may state the
1 9 applicant's race and ethnicity. The department shall adopt
1 10 rules specifying the racial and ethnic designations the
1 11 application shall contain consistent with the uniform crime
1 12 reporting handbook, national incident=based reporting system
1 13 (NIBRS) edition (1992). The application may contain other
1 14 information the department may require by rule. Pursuant to
1 15 procedures established by the department and for an applicant
1 16 who is a foreign national temporarily present in this state,
1 17 the department may waive the requirement that the application
1 18 include the applicant's social security number.
1 19 Sec. 2. Section 321.189, subsection 2, paragraph a, Code
1 20 2005 is amended to read as follows:
1 21 a. Appearing on the driver's license shall be a
1 22 distinguishing number assigned to the licensee; the licensee's
1 23 full name, date of birth, sex, and residence address; a
1 24 colored photograph; a physical description of the licensee;
1 25 the name of the state; the dates of issuance and expiration;
1 26 and the usual signature of the licensee. The license shall
1 27 identify, in machine=readable format only, the race and
1 28 ethnicity of the licensee if reported on the application for
1 29 the license. The license shall identify the class of vehicle
1 30 the licensee may operate and the applicable endorsements and
1 31 restrictions which the department shall require by rule.
1 32 Sec. 3. Section 321.190, subsection 1, paragraph a, Code
1 33 2005, is amended to read as follows:
1 34 a. The department shall, upon application and payment of
1 35 the required fee, issue to an applicant a nonoperator's
2 1 identification card. To be valid the card shall bear a
2 2 distinguishing number assigned to the card holder, the full
2 3 name, date of birth, sex, residence address, a physical
2 4 description and a colored photograph of the card holder, the
2 5 usual signature of the card holder, and such other information
2 6 as the department may require by rule. The nonoperator's
2 7 identification card shall identify, in machine=readable format
2 8 only, the race and ethnicity of the licensee if reported on
2 9 the application for the card. An applicant for a
2 10 nonoperator's identification card shall apply for the card in
2 11 the manner provided in section 321.182, subsections 1 through
2 12 3. The card shall be issued to the applicant at the time of
2 13 application pursuant to procedures established by rule. An
2 14 applicant for a nonoperator's identification card who is
2 15 required by 50 U.S.C. app. } 451 et seq. to register with the
2 16 United States selective service system shall be registered by
2 17 the department with the selective service system as provided
2 18 in section 321.183.
2 19 Sec. 4. EFFECTIVE DATE AND APPLICABILITY. This Act takes
2 20 effect July 1, 2007, and applies to all new, duplicate,
2 21 substitute, and replacement driver's licenses and
2 22 nonoperator's identification cards, and to driver's license
2 23 renewals, applied for on or after that date.
2 24 EXPLANATION
2 25 This bill provides the means for an applicant for a
2 26 driver's license or nonoperator's identification card to
2 27 report the applicant's race and ethnicity along with other
2 28 information currently required of applicants. The state
2 29 department of transportation is to adopt rules specifying
2 30 racial and ethnic designations to be used on application
2 31 forms. The designations are to be consistent with the
2 32 guidelines contained in the national incident=based reporting
2 33 system (NIBRS) edition of the uniform crime reporting
2 34 handbook. The bill requires that a driver's license or
2 35 nonoperator's identification card shall contain the racial and
3 1 ethnic designations of the licensee or cardholder if reported,
3 2 but only in machine=readable format.
3 3 The bill is effective July 1, 2007, and applies to driver's
3 4 licenses and nonoperator's identification cards applied for on
3 5 or after that date.
