  1  1    Section 1.  Section 124.401, subsection 1, Code 2005, is
  1  2 amended by adding the following new paragraph:
  1  3    NEW PARAGRAPH.  g.  A firearm in the immediate possession
  1  4 or control of a person in violation of this subsection shall
  1  5 be subject to forfeiture pursuant to section 809A.4.
  1  6                           EXPLANATION
  1  7    This bill provides that a firearm in the immediate
  1  8 possession or control of a person who has manufactured,
  1  9 delivered, or possessed with the intent to manufacture or
  1 10 deliver a controlled substance, a counterfeit substance, or a
  1 11 simulated controlled substance, or who has acted with, entered
  1 12 into a common scheme or design with, or conspired with one or
  1 13 more persons to manufacture, deliver, or possess with the
  1 14 intent to manufacture or deliver a controlled substance, a
  1 15 counterfeit substance, or a simulated controlled substance, in
  1 16 violation of Code section 124.401, shall be subject to
  1 17 forfeiture pursuant to Code section 809A.4.
