1 1 Section 1. Section 331.461, subsection 2, Code 2005, is
1 2 amended by adding the following new paragraph:
1 3 NEW PARAGRAPH. i. Port facilities or port facilities
1 4 systems, including without limitation, real and personal
1 5 property, water, buildings, improvements, and equipment useful
1 6 and suitable for taking care of the needs of commerce and
1 7 shipping, and also including without limitation, wharves,
1 8 docks, basins, piers, quay walls, warehouses, tunnels, belt
1 9 railway facilities, cranes, dock apparatus, and other
1 10 machinery necessary for the convenient and economical
1 11 accommodation and handling of watercraft of all kinds and of
1 12 freight and passengers.
1 13 EXPLANATION
1 14 Counties and cities are authorized by statute to create
1 15 county or city enterprises for certain purposes which are
1 16 specified in statute under the definitions of "county
1 17 enterprise" and "city enterprise". A board of supervisors (or
1 18 city council) may establish by ordinance rates to be charged
1 19 for the services of a county (or city) enterprise. Debt may
1 20 be incurred to finance county (or city) enterprise projects
1 21 and such debt is payable from the net revenues of the county
1 22 (or city) enterprise.
1 23 This bill adds port facilities and port facilities systems
1 24 to the definition of county enterprise. Currently, port
1 25 facilities and port facilities systems are included in the
1 26 definition of city enterprise in Code section 384.24.
