  1  1    Section 1.  Section 423.3, Code Supplement 2005, is amended
  1  2 by adding the following new subsection:
  1  3    NEW SUBSECTION.  89.  The sales price from the sales or
  1  4 furnishing of materials, equipment, and services which are
  1  5 directly used for the production of master audio, video, film,
  1  6 or digital recordings or similar media.
  1  7    The exemption under this subsection does not apply to the
  1  8 production of master audio, video, film, or digital recordings
  1  9 or similar media that depict or describe any obscene material,
  1 10 as defined in section 728.1.
  1 11                           EXPLANATION
  1 12    This bill exempts from state sales and use taxes the sales
  1 13 and furnishing of materials, equipment, and services which are
  1 14 directly used for the production of master audio, video, film,
  1 15 or digital recordings or similar media.  The exemption does
  1 16 not apply if the production of the media depicts or describes
  1 17 obscene material.
