A BILL FOR
1 An Act relating to building regulations, by establishing an
2 internet website in the office of the state building code
3 commissioner and requiring local governmental entities to
4 report the adoption or amendment of local building
5 regulations, and providing an effective date.
6 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 103A.5, Code 2005, is amended by adding
1 2 the following new subsection:
1 3 NEW SUBSECTION. 6. Develop and maintain a publicly
1 4 accessible internet website that lists state and local
1 5 building regulations. The commissioner shall create a form
1 6 for submission of building regulations, and make such form
1 7 available electronically and in paper form. If a governmental
1 8 subdivision has not adopted building regulations, the
1 9 commissioner shall so indicate on the website. The
1 10 commissioner may include a summary of the state building code
1 11 on the website, describing in plain language the structures to
1 12 which the code applies; however, a disclaimer shall be posted
1 13 with the summary that it is not an official, binding
1 14 interpretation of the state building code.
1 15 Sec. 2. NEW SECTION. 103A.24 LOCAL BUILDING REGULATIONS.
1 16 The governing body of a governmental subdivision that
1 17 enacts an ordinance adopting local building regulations,
1 18 including amendments thereto, relating to any building or
1 19 structure within the boundaries of the governmental
1 20 subdivision shall report such adoption to the commissioner on
1 21 a form provided by the commissioner within thirty days after
1 22 the ordinance is effective.
1 23 Sec. 3. REPORTING REQUIREMENT. The governing body of each
1 24 governmental subdivision shall report to the commissioner on a
1 25 form provided by the commissioner all local building
1 26 regulations relating to any building or structure within the
1 27 boundaries of the governmental subdivision to the office of
1 28 the commissioner on or before October 1, 2006. If a
1 29 governmental subdivision has not adopted any local building
1 30 regulations, the governing body shall so report to the
1 31 commissioner on a form provided by the commissioner on or
1 32 before October 1, 2006.
1 33 Sec. 4. EFFECTIVE DATE. This Act, being deemed of
1 34 immediate importance, takes effect upon enactment.
1 35 EXPLANATION
2 1 This bill establishes an internet website in the office of
2 2 the state building code commissioner for the public to have
2 3 access to information on building regulations across the
2 4 state. The commissioner is required to create a form for
2 5 governmental subdivisions to submit building regulations. If
2 6 a city or county does not have any building regulations, the
2 7 commissioner is required to note this on the website. The
2 8 bill allows the commissioner to include a summary of the state
2 9 building code provisions on the website; however, a disclaimer
2 10 must be posted on the website that the summary is not an
2 11 official, binding interpretation of the state building code.
2 12 The bill requires the governing body of a governmental
2 13 subdivision that enacts an ordinance adopting local building
2 14 regulations, including amendments thereto, to report such
2 15 adoption on a form provided by the commissioner.
2 16 The governing body of each governmental subdivision is
2 17 required to report to the commissioner all adopted building
2 18 regulations relating to any building or structure within its
2 19 limits to the office of the commissioner on or before October
2 20 1, 2006. If no local building regulations have been adopted,
2 21 the governing body of such governmental subdivision must
2 22 report this fact to the commissioner on or before October 1,
2 23 2006.
2 24 The bill takes effect upon enactment.
