  1  1    Section 1.  NEW SECTION.  455B.191A  CONTAMINATION OF WATER
  1  2 SUPPLY == LIABILITY.
  1  3    In addition to payment of any applicable penalty under this
  1  4 chapter or other provision of law, a person who causes the
  1  5 contamination of a private water supply or public water supply
  1  6 system to the extent that potable water cannot be provided to
  1  7 the users of the private water supply or public water supply
  1  8 system shall be liable for all costs associated with the
  1  9 testing and repair of the water system and the costs
  1 10 associated with providing potable water to the users of the
  1 11 private water supply or public water supply system while the
  1 12 water system is contaminated.
  1 13                           EXPLANATION
  1 14    This bill provides that a person who causes the
  1 15 contamination of a private water supply or public water supply
  1 16 system to the extent that potable water cannot be provided to
  1 17 the users of the water system shall be liable for all costs
  1 18 associated with the testing and repair of the water system and
  1 19 the costs associated with providing potable water to the users
  1 20 of the water system while the water system is contaminated.
