  1  1    Section 1.  Section 708.2A, subsection 5, paragraph a, Code
  1  2 2005, is amended to read as follows:
  1  3    a.  A conviction for, deferred judgment for, or plea of
  1  4 guilty to, a violation of this section which occurred more
  1  5 than six twelve years prior to the date of the violation
  1  6 charged shall not be considered in determining that the
  1  7 violation charged is a second or subsequent offense.
  1  8                           EXPLANATION
  1  9    This bill provides that a conviction for, deferred judgment
  1 10 for, or plea of guilty to a domestic abuse assault in
  1 11 violation of Code section 708.2A, which occurred more than 12
  1 12 years prior to the date of the domestic abuse assault, shall
  1 13 not be considered in determining that the current charge of
  1 14 domestic abuse assault is a second or subsequent offense.
  1 15 Current law does not allow consideration of such offenses
  1 16 which occurred more than six years prior to the date of the
  1 17 domestic abuse assault.
