1 An Act relating to the training of mandatory reporters of abuse
2 by requiring the training to address identification of
3 domestic abuse.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 232.69, subsection 3, paragraph b, Code
1 2 Supplement 2005, is amended to read as follows:
1 3 b. A person required to make a report under subsection 1,
1 4 other than a physician whose professional practice does not
1 5 regularly involve providing primary health care to children,
1 6 shall complete two hours of training relating to the
1 7 identification and reporting of child abuse within six months
1 8 of initial employment or self=employment involving the
1 9 examination, attending, counseling, or treatment of children
1 10 on a regular basis. Within one month of initial employment or
1 11 self=employment, the person shall obtain a statement of the
1 12 abuse reporting requirements from the person's employer or, if
1 13 self=employed, from the department. The person shall complete
1 14 at least two hours of additional child abuse identification
1 15 and reporting training every five years. The initial and
1 16 additional training shall include but is not limited to a
1 17 component on identification of domestic abuse.
1 18 Sec. 2. Section 235B.16, subsection 5, paragraph b, Code
1 19 2005, is amended to read as follows:
1 20 b. A person required to report cases of dependent adult
1 21 abuse pursuant to section 235B.3, other than a physician whose
1 22 professional practice does not regularly involve providing
1 23 primary health care to adults, shall complete two hours of
1 24 training relating to the identification and reporting of
1 25 dependent adult abuse within six months of initial employment
1 26 or self=employment which involves the examination, attending,
1 27 counseling, or treatment of adults on a regular basis. Within
1 28 one month of initial employment or self=employment, the person
1 29 shall obtain a statement of the abuse reporting requirements
1 30 from the person's employer or, if self=employed, from the
1 31 department. The person shall complete at least two hours of
1 32 additional dependent adult abuse identification and reporting
1 33 training every five years. The initial and additional
1 34 training shall include but is not limited to a component on
1 35 identification of domestic abuse.
2 1 EXPLANATION
2 2 This bill relates to the training of mandatory reporters of
2 3 abuse by requiring the training to address identification of
2 4 domestic abuse.
2 5 Under current law in Code section 232.69, relating to
2 6 reporting of child abuse, and in Code section 235B.16,
2 7 relating to reporting of dependent adult abuse, a mandatory
2 8 reporter of either type of abuse is required to have at least
2 9 two hours of initial training and follow=up training at least
2 10 every five years regarding the abuse that is required to be
2 11 reported. The bill amends both of the provisions to require
2 12 the initial and additional training to include a component on
2 13 identification of domestic abuse.
