  1  1    Section 1.  NEW SECTION.  319.16  REMOVAL OF DEER
  1  2 CARCASSES.
  1  3    1.  The department shall remove a deer carcass located on a
  1  4 road or right=of=way under its jurisdiction.
  1  5    2.  The department shall deliver a deer carcass removed
  1  6 pursuant to subsection 1 to the department of natural
  1  7 resources at a location designated by the department of
  1  8 natural resources by rule.
  1  9    Sec. 2.  NEW SECTION.  481A.2A  DISPOSAL OF ROAD=KILLED
  1 10 DEER CARCASSES.
  1 11    1.  The department shall accept delivery of a deer carcass
  1 12 delivered to the department pursuant to section 319.16 and
  1 13 shall dispose of the carcass.
  1 14    2.  The department, in consultation with the state
  1 15 department of transportation, shall adopt rules designating
  1 16 the locations where deer carcasses will be accepted.
  1 17                           EXPLANATION
  1 18    This bill requires the state department of transportation
  1 19 to remove any deer carcass located on a road or right=of=way
  1 20 over which the department has jurisdiction.  Currently, the
  1 21 department is required to remove obstructions from the
  1 22 traveled portions of a highway, but is not required to remove
  1 23 a deer carcass from a right=of=way.  The state department of
  1 24 transportation must deliver the deer carcass to the department
  1 25 of natural resources at a location designated by rule of the
  1 26 department of natural resources.
  1 27    The bill also requires the department of natural resources
  1 28 to accept delivery of a deer carcass removed from a road or
  1 29 right=of=way by the state department of transportation.  The
  1 30 department of natural resources must dispose of the deer
  1 31 carcass.
