  1  1    Section 1.  Section 232.52, subsection 2, paragraph e,
  1  2 subparagraph (2), Code Supplement 2005, is amended to read as
  1  3 follows:
  1  4    (2)  The child has committed an act which is a crime
  1  5 against a person and which would be an aggravated misdemeanor
  1  6 or a felony if the act were committed by an adult.
  1  7                           EXPLANATION
  1  8    This bill relates to placement of a juvenile in the state
  1  9 training school or other facility.
  1 10    The bill strikes language relating to a juvenile's
  1 11 commission of a crime against a person that is an aggravated
  1 12 misdemeanor or felony as one of the conditions that would
  1 13 allow a court to order placement in the state training school.
  1 14 The bill provides that a juvenile only commit a crime that is
  1 15 an aggravated misdemeanor or felony as a condition for
  1 16 placement in the state training school.  The bill does not
  1 17 change any of the other conditions that make a juvenile
  1 18 eligible for the state training school.
  1 19    Under the bill, a juvenile becomes eligible for placement
  1 20 at the state training school or any other facility if the
  1 21 court finds any three of the following conditions exist:  (1)
  1 22 the child is at least 15 years of age and the court finds the
  1 23 placement to be in the best interests of the child or the
  1 24 public; (2) the child has committed an act that would be an
  1 25 aggravated misdemeanor or a felony if committed by an adult;
  1 26 (3) the child has previously been found to have committed a
  1 27 delinquent act; or (4) the child has previously been placed in
  1 28 a treatment facility outside the child's home or in a
  1 29 supervised treatment facility.
