  1  1    Section 1.  Section 22.7, subsection 5, Code Supplement
  1  2 2005, is amended to read as follows:
  1  3    5.  Peace officers' investigative reports, and specific
  1  4 portions of electronic mail and telephone billing records of
  1  5 law enforcement agencies if that information is part of an
  1  6 investigation, except where disclosure is authorized elsewhere
  1  7 in this Code.  However, the date, time, specific location, and
  1  8 immediate facts and circumstances surrounding a crime or
  1  9 incident shall not be kept confidential under this section,
  1 10 except in those unusual circumstances where disclosure would
  1 11 plainly and seriously jeopardize an investigation or pose a
  1 12 clear and present danger to the safety of an individual.
  1 13                           EXPLANATION
  1 14    This bill amends Code chapter 22, the open records law, to
  1 15 make electronic mail and telephone billing records of law
  1 16 enforcement agencies confidential if that information is part
  1 17 of an investigation.
