1 3 Section 1. ADMINISTRATION. There is appropriated from the
1 4 general fund of the state to the department for the blind for
1 5 the fiscal year beginning July 1, 2006, and ending June 30,
1 6 2007, the following amount, or so much thereof as is
1 7 necessary, to be used for the purposes designated:

2 21 Sec. 3. WORK=STUDY APPROPRIATION FOR FY 2006=2007.
2 22 Notwithstanding section 261.85, for the fiscal year beginning
2 23 July 1, 2006, and ending June 30, 2007, the amount
2 24 appropriated from the general fund of the state to the college
2 25 student aid commission for the work=study program under
2 26 section 261.85 shall be $140,000, and from the moneys
2 27 appropriated in this section, $76,365 shall be allocated to
2 28 institutions of higher education under the state board of
2 29 regents and community colleges and the remaining dollars
2 30 appropriated in this section shall be allocated by the college
2 31 student aid commission on the basis of need as determined by
2 32 the portion of the federal formula for distribution for work=
2 33 study funds that relates to the current need of institutions.
2 34 Sec. 4. REGISTERED NURSE RECRUITMENT PROGRAM FUNDS. From
2 35 the funds appropriated for tuition grants pursuant to section
3 1 261.25, subsection 1, as amended in this Act, for the fiscal
3 2 year beginning July 1, 2006, up to fifty thousand dollars
3 3 shall be used to provide forgivable loans as provided in
3 4 section 261.23 to residents of Iowa who are registered nurses
3 5 and who are seeking to become qualified as nursing faculty in
3 6 Iowa and to teach in Iowa schools. To qualify for a
3 7 forgivable loan pursuant to this section, in addition to the
3 8 requirements of section 261.23, a person shall be enrolled as
3 9 a full=time or part=time student at a not=for=profit
3 10 accredited school of nursing located in this state. Moneys
3 11 allocated for purposes of this section shall be allocated only
3 12 to the extent that the state moneys are matched on a dollar=
3 13 for=dollar basis from other sources. The college student aid
3 14 commission shall submit in a report to the chairpersons and
3 15 ranking members of the joint subcommittee on education
3 16 appropriations by January 1, 2007, the number of students who
3 17 received forgivable loans in the fiscal year beginning July 1,
3 18 2006, pursuant to this section, which institutions the
3 19 students were enrolled in, and the amount paid to each of the
3 20 institutions on behalf of the students who received forgivable
3 21 loans pursuant to this section.
3 22 DEPARTMENT OF CULTURAL AFFAIRS
3 23 Sec. 5. There is appropriated from the general fund of the
3 24 state to the department of cultural affairs for the fiscal
3 25 year beginning July 1, 2006, and ending June 30, 2007, the
3 26 following amounts, or so much thereof as is necessary, to be
3 27 used for the purposes designated:

5 2 Sec. 6. There is appropriated from the general fund of the
5 3 state to the department of education for the fiscal year
5 4 beginning July 1, 2006, and ending June 30, 2007, the
5 5 following amounts, or so much thereof as may be necessary, to
5 6 be used for the purposes designated:

5 13 The director of the department of education shall ensure
5 14 that all school districts are aware of the state education
5 15 resources available on the state website for listing teacher
5 16 job openings and shall make every reasonable effort to enable
5 17 qualified practitioners to post their resumes on the state
5 18 website. The department shall administer the posting of job
5 19 vacancies for school districts, accredited nonpublic schools,
5 20 and area education agencies on the state website. The
5 21 department may coordinate this activity with the Iowa school
5 22 board association or other interested education associations
5 23 in the state. The department shall strongly encourage school
5 24 districts to seek direct claiming under the medical assistance
5 25 program for funding of school district nursing services for
5 26 students.
5 27 2. VOCATIONAL EDUCATION ADMINISTRATION

6 4 The division of vocational rehabilitation services shall
6 5 seek funding from other sources, such as local funds, for

6 10 Except where prohibited under federal law, the division of
6 11 vocational rehabilitation services of the department of
6 12 education shall accept client assessments, or assessments of
6 13 potential clients, performed by other agencies in order to
6 14 reduce duplication of effort.
6 15 Notwithstanding the full=time equivalent position limit
6 16 established in this lettered paragraph, for the fiscal year
6 17 ending June 30, 2007, if federal funding is received to pay
6 18 the costs of additional employees for the vocational
6 19 rehabilitation services division who would have duties
6 20 relating to vocational rehabilitation services paid for
6 21 through federal funding, authorization to hire not more than
6 22 4.00 additional full=time equivalent employees shall be
6 23 provided, the full=time equivalent position limit shall be
6 24 exceeded, and the additional employees shall be hired by the
6 25 division.
6 26 b. For matching funds for programs to enable persons with
6 27 severe physical or mental disabilities to function more
6 28 independently, including salaries and support, and for not
6 29 more than the following full=time equivalent position:

7 28 8. VOCATIONAL EDUCATION TO SECONDARY SCHOOLS
7 29 For reimbursement for vocational education expenditures
7 30 made by secondary schools:

7 32 Funds appropriated in this subsection shall be used for
7 33 expenditures made by school districts to meet the standards
7 34 set in sections 256.11, 258.4, and 260C.14 as a result of the
7 35 enactment of 1989 Iowa Acts, chapter 278. Funds shall be used
8 1 as reimbursement for vocational education expenditures made by
8 2 secondary schools in the manner provided by the department of
8 3 education for implementation of the standards set in 1989 Iowa
8 4 Acts, chapter 278.
8 5 9. SCHOOL FOOD SERVICE
8 6 For use as state matching funds for federal programs that
8 7 shall be disbursed according to federal regulations, including
8 8 salaries, support, maintenance, miscellaneous purposes, and
8 9 for not more than the following full=time equivalent

8 14 For deposit in the school ready children grants account of
8 15 the Iowa empowerment fund created in section 28.9:

8 17 a. From the moneys deposited in the school ready children
8 18 grants account for the fiscal year beginning July 1, 2006, and
8 19 ending June 30, 2007, not more than $300,000 is allocated for
8 20 the community empowerment office and other technical
8 21 assistance activities and of that amount, not more than
8 22 $50,000 shall be used to administer the early childhood
8 23 coordinator's position pursuant to section 28.3, subsection 7,
8 24 and not more than $50,000 shall be used to implement an early
8 25 childhood Iowa website for wide dissemination of early care
8 26 and early childhood learning information and assistance. It
8 27 is the intent of the general assembly that regional technical
8 28 assistance teams will be established and will include staff
8 29 from various agencies, as appropriate, including the area
8 30 education agencies, community colleges, and the Iowa state
8 31 university of science and technology cooperative extension
8 32 service in agriculture and home economics. The Iowa
8 33 empowerment board shall direct staff to work with the advisory
8 34 council to inventory technical assistance needs. Funds
8 35 allocated under this lettered paragraph may be used by the
9 1 Iowa empowerment board for the purpose of skills development
9 2 and support for ongoing training of the regional technical
9 3 assistance teams. However, funds shall not be used for
9 4 additional staff or for the reimbursement of staff.
9 5 b. Notwithstanding any other provision of law to the
9 6 contrary, the community empowerment office shall use the
9 7 documentation created by the legislative services agency to
9 8 continue the implementation of the four=year phase=in period
9 9 of the distribution formula approved by the community
9 10 empowerment board.
9 11 c. As a condition of receiving funding appropriated in
9 12 this subsection, each community empowerment area board shall
9 13 report to the Iowa empowerment board progress on each of the
9 14 state indicators approved by the state board, as well as
9 15 progress on local indicators. The community empowerment area
9 16 board must also submit a written plan amendment extending by
9 17 one year the area's comprehensive school ready children grant
9 18 plan developed for providing services for children from birth
9 19 through five years of age and provide other information
9 20 specified by the Iowa empowerment board. The amendment may
9 21 also provide for changes in the programs and services provided
9 22 under the plan. The Iowa empowerment board shall establish a
9 23 submission deadline for the plan amendment that allows a
9 24 reasonable period of time for preparation of the plan
9 25 amendment and for review and approval or request for
9 26 modification of the plan amendment by the Iowa empowerment
9 27 board. In addition, the community empowerment board must
9 28 continue to comply with reporting provisions and other
9 29 requirements adopted by the Iowa empowerment board in
9 30 implementing section 28.8.
9 31 d. Of the amount appropriated in this subsection for
9 32 deposit in the school ready children grants account of the
9 33 Iowa empowerment fund that is used for distribution to areas,
9 34 $4,650,000 shall be used to assist low=income parents with
9 35 preschool tuition.
10 1 e. Of the amount appropriated in this subsection for
10 2 deposit in the school ready children grants account of the
10 3 Iowa empowerment fund that is used for distribution to areas,
10 4 $1,000,000 shall be used to collaborate with area education
10 5 agencies and community colleges to provide both child care and
10 6 preschool providers with ready access to high=quality
10 7 professional development.
10 8 11. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS
10 9 To provide funds for costs of providing textbooks to each
10 10 resident pupil who attends a nonpublic school as authorized by
10 11 section 301.1. The funding is limited to $20 per pupil and
10 12 shall not exceed the comparable services offered to resident
10 13 public school pupils:

11 23 Sec. 7. COMMUNITY COLLEGE DATA COLLECTION. By October 1,
11 24 2007, each community college shall submit to the chairpersons
11 25 and ranking members of the joint appropriations subcommittee
11 26 on education and the legislative services agency the following
11 27 information for the 2006=2007 fiscal year:
11 28 1. Total revenue received from each local school district
11 29 as a result of high school students enrolled in community
11 30 college courses under the postsecondary enrollment options
11 31 Act.
11 32 2. Total revenue received from each local school district
11 33 as a result of high school students enrolled in community
11 34 college courses through shared supplementary weighting plans.
11 35 3. Unduplicated headcount of high school students enrolled
12 1 in community college courses under the postsecondary
12 2 enrollment options Act.
12 3 4. Unduplicated headcount of high school students enrolled
12 4 in community college courses through shared supplementary
12 5 weighting plans.
12 6 5. Total credits earned by high school students enrolled
12 7 in community college courses under the postsecondary
12 8 enrollment options Act, broken down by vocational=technical or
12 9 career program and arts and sciences program.
12 10 6. Number of courses in which high school students are
12 11 enrolled under shared supplementary weighting plans and the
12 12 portions of those courses that are taught by an instructor who
12 13 is employed by the local school district for a portion of the
12 14 school day.
12 15 Sec. 8. DEPARTMENT OF EDUCATION == HIGH SCHOOL GRADUATE
12 16 ACADEMIC EXPERIENCE DATA COLLECTION STUDY. The department of
12 17 education, in collaboration with the institutions of higher
12 18 education governed by the state board of regents and
12 19 representatives of the community colleges, shall study the
12 20 development and collection of summary data on the academic
12 21 experiences of Iowa high school graduates that enroll in an
12 22 Iowa public postsecondary institution. The study shall
12 23 identify the types of data to be compiled from postsecondary
12 24 institutions, including but not limited to the hours attempted
12 25 or completed during a student's first semester, or the quarter
12 26 or trimester equivalent, or first year of study at a
12 27 postsecondary institution; a student's grade point average
12 28 earned during the first semester, or the quarter or trimester
12 29 equivalent, or first year of study at a postsecondary
12 30 institution; the high school rank of a student, if known;
12 31 indicators of whether the student was assigned to a
12 32 developmental or remedial course in English, mathematics, or
12 33 reading; and an indicator for whether the student returned for
12 34 the second year to the institution. The study shall consider
12 35 the limitations imposed by the federal Family Educational
13 1 Rights and Privacy Act, 20 U.S.C. } 1232g, 34 C.F.R. Part 99,
13 2 regarding the disclosure by a school of information from a
13 3 student's education record. The department shall submit its
13 4 findings, and a recommendation for a timeline of
13 5 implementation, in a report to the chairpersons and ranking
13 6 members of the joint appropriations subcommittee on education
13 7 by January 1, 2007.
13 8 Sec. 9. STATEWIDE TEACHER INTERN PROGRAM == FEDERAL GRANT
13 9 APPLICATION COORDINATION. The department shall work
13 10 cooperatively with the state board of regents and other
13 11 appropriate eligible grantees to obtain any available federal
13 12 funding, including grants that may be available for the
13 13 establishment and operation of a teacher intern program. The
13 14 department shall submit a progress report to the chairpersons
13 15 and ranking members of the joint appropriations subcommittee
13 16 on education by January 1, 2007.
13 17 Sec. 10. MINIMUM TEACHER SALARY REQUIREMENTS == FY 2006=
13 18 2007.
13 19 1. Notwithstanding section 284.7, subsection 1, paragraph
13 20 "a", subparagraph (2), the minimum teacher salary paid by a
13 21 school district or area education agency for purposes of
13 22 teacher compensation in accordance with chapter 284, for the
13 23 fiscal year beginning July 1, 2006, and ending June 30, 2007,
13 24 shall be the minimum salary amount the school district or area
13 25 education agency paid to a first=year beginning teacher or,
13 26 the minimum salary amount the school district or area
13 27 education agency would have paid a first=year beginning
13 28 teacher if the school district or area education agency had
13 29 participated in the program in the 2001=2002 school year, in
13 30 accordance with section 284.7, subsection 1, Code Supplement
13 31 2001. If the school district or area education agency did not
13 32 employ a first=year beginning teacher in the 2001=2002 school
13 33 year, the minimum salary is the amount that the district would
13 34 have paid a first=year beginning teacher under chapter 284 in
13 35 the 2001=2002 school year.
14 1 2. Notwithstanding section 284.7, subsection 1, paragraph
14 2 "b", subparagraph (2), the minimum career teacher salary paid
14 3 to a career teacher who was a beginning teacher in the 2005=
14 4 2006 school year, by a school district or area education
14 5 agency participating in the student achievement and teacher
14 6 quality program, for the school year beginning July 1, 2006,
14 7 and ending June 30, 2007, shall be, unless the school district
14 8 has a minimum career teacher salary that exceeds thirty
14 9 thousand dollars, one thousand dollars greater than the
14 10 minimum salary amount the school district or area education
14 11 agency paid to a first=year beginning teacher if the school
14 12 district or area education agency participated in the program
14 13 during the 2001=2002 school year, or the minimum salary amount
14 14 the school district or area education agency would have paid a
14 15 first=year beginning teacher if the school district or area
14 16 education agency had participated in the program in the 2001=
14 17 2002 school year, in accordance with section 284.7, subsection
14 18 1, Code Supplement 2001.
14 19 3. Notwithstanding section 284.7, subsection 1, paragraph
14 20 "b", subparagraph (2), and except as provided in subsection 2,
14 21 the minimum career teacher salary paid by a school district or
14 22 area education agency participating in the student achievement
14 23 and teacher quality program, for purposes of teacher
14 24 compensation in accordance with chapter 284, for the school
14 25 year beginning July 1, 2006, and ending June 30, 2007, shall
14 26 be the minimum salary amount the school district or area
14 27 education agency paid to a career teacher if the school
14 28 district or area education agency participated in the program
14 29 during the 2001=2002 school year, or, the minimum salary
14 30 amount the school district or area education agency would have
14 31 paid a career teacher if the school district or area education
14 32 agency had participated in the program in the 2001=2002 school
14 33 year, in accordance with section 284.7, subsection 1, Code
14 34 Supplement 2001.
14 35 STATE BOARD OF REGENTS
15 1 Sec. 11. There is appropriated from the general fund of
15 2 the state to the state board of regents for the fiscal year
15 3 beginning July 1, 2006, and ending June 30, 2007, the
15 4 following amounts, or so much thereof as may be necessary, to
15 5 be used for the purposes designated:

15 22 and technology, and the university of northern Iowa to
15 23 reimburse the institutions for deficiencies in their operating
15 24 funds resulting from the pledging of tuitions, student fees
15 25 and charges, and institutional income to finance the cost of
15 26 providing academic and administrative buildings and facilities
15 27 and utility services at the institutions:

16 15 (1) The partnership for transformation and excellence is a
16 16 four=year partnership plan created by the state board of
16 17 regents for the purpose of enhancing the regents' strategic
16 18 priorities for educational quality and public accountability.
16 19 Under the plan, Iowa students and families will be subject to
16 20 moderate student tuition increases, and a clear and concise
16 21 reallocation plan that may be audited will exist to strengthen
16 22 the academic focus at the regents institutions. The
16 23 reallocation plan will enhance the quality of the regents
16 24 institutions and provide both an incentive and an opportunity
16 25 for institution=wide reprioritization and reallocation of
16 26 resources to the most important strategic areas.
16 27 (2) The funds shall be distributed by the board as
16 28 outlined in the state board of regents partnership for
16 29 transformation and excellence. The funds may be used for any
16 30 of the following purposes:
16 31 (a) Supporting new strategic initiatives.
16 32 (b) Meeting enrollment increases.
16 33 (c) Meeting the demand for new courses and services.
16 34 (d) Funding new but unavoidable or mandated cost
16 35 increases.
17 1 (e) Supporting any other initiatives important to the core
17 2 functions of the institution.
17 3 The funds may also be used for pay adjustments, expense
17 4 reimbursements, and related benefits for state board of
17 5 regents employees covered by a collective bargaining agreement
17 6 and for state board of regents employees not covered by a
17 7 collective bargaining agreement. The board shall provide from
17 8 other available sources any additional funding needed for such
17 9 pay adjustments, expense reimbursements, and related benefits.
17 10 (3) The state board of regents shall annually set a target
17 11 dollar amount or percentage figure of expected reallocation of
17 12 resources for each institution. The institutions shall report
17 13 to the board on a semiannual basis regarding the actions taken
17 14 relating to the reallocations. Once funds have been
17 15 reallocated, that amount shall not be redirected to the
17 16 original entity or purpose unless extraordinary circumstances
17 17 exist and an equivalent reallocation amount is increased for
17 18 the same fiscal year. A reallocation of resources may be made
17 19 for any of the following purposes:
17 20 (a) Supporting new strategic initiatives.
17 21 (b) Meeting enrollment increases.
17 22 (c) Meeting the demand for new courses and services.
17 23 (d) Funding new but unavoidable or mandated cost
17 24 increases.
17 25 (e) Supporting any other initiatives important to the core
17 26 functions of the institution.
17 27 (4) For the purposes of this lettered paragraph:
17 28 (a) "Entity" means a president, vice president, or a
17 29 college, academic or nonacademic department, division,
17 30 program, or other unit.
17 31 (b) "Reallocation of resources" means funds within the
17 32 base budget of an institutional entity are removed by the
17 33 administrator of that entity and redirected to another
17 34 institutional entity or purpose.
17 35 (5) The state university of Iowa, the Iowa state
18 1 university of science and technology, and the university of
18 2 northern Iowa shall each generate matching internal
18 3 reallocations in an amount equal to 50 percent of the amounts
18 4 received by the institutions pursuant to this lettered
18 5 paragraph.
18 6 (6) From the moneys allocated to the Iowa state university
18 7 of science and technology pursuant to this lettered paragraph,
18 8 an amount equal to $127,000 shall be distributed to the
18 9 college of veterinary medicine to reduce the operating fees
18 10 charged by the veterinary diagnostic laboratory.
18 11 The college of veterinary medicine shall submit a report to
18 12 the general assembly not later than October 1, 2007, on how
18 13 funds allocated pursuant to this subparagraph were used by the
18 14 college to reduce the operating fees charged by the veterinary
18 15 diagnostic laboratory.

23 11 Sec. 13. Notwithstanding section 270.7, the department of
23 12 administrative services shall pay the state school for the
23 13 deaf and the Iowa braille and sight saving school the moneys
23 14 collected from the counties during the fiscal year beginning
23 15 July 1, 2006, for expenses relating to prescription drug costs
23 16 for students attending the state school for the deaf and the
23 17 Iowa braille and sight saving school.
23 18 Sec. 14. TRAVEL POLICY.
23 19 1. For the fiscal year beginning July 1, 2006, each
23 20 department or independent agency receiving an appropriation in
23 21 this Act shall review the employee policy for daily or short=
23 22 term travel including but not limited to the usage of motor
23 23 pool vehicles under the department of administrative services,
23 24 employee mileage reimbursement for the use of a personal
23 25 vehicle, and the usage of private automobile rental companies.
23 26 Following the review, the department or agency shall implement
23 27 revisions in the employee policy for daily or short=term
23 28 travel as necessary to maximize cost savings.
23 29 2. Each department or independent agency subject to
23 30 subsection 1 shall report to the general assembly's standing
23 31 committees on government oversight regarding the policy
23 32 revisions implemented and the savings realized from the
23 33 changes. An initial report shall be submitted on or before
23 34 December 1, 2006, and a follow=up report shall be submitted on
23 35 or before December 1, 2007.
24 1 Sec. 15. NEW SECTION. 256.57 ENRICH IOWA PROGRAM.
24 2 1. An enrich Iowa program is established in the division
24 3 to provide direct state assistance to public libraries, to
24 4 support the open access and access plus programs, to provide
24 5 public libraries with an incentive to improve library
24 6 services, and that are in compliance with performance
24 7 measures, and to reduce inequities among communities in the
24 8 delivery of library services based on performance measures
24 9 adopted by rule by the commission. The commission shall adopt
24 10 rules governing the allocation of funds appropriated by the
24 11 general assembly for purposes of this section to provide
24 12 direct state assistance to eligible public libraries. A
24 13 public library is eligible for funds under this chapter if it
24 14 is in compliance with the commission's performance measures.
24 15 2. The amount of direct state assistance distributed to
24 16 each eligible public library shall be based on the following:
24 17 a. The level of compliance by the eligible public library
24 18 with the performance measures adopted by the commission as
24 19 provided in this paragraph.
24 20 b. The number of people residing within an eligible
24 21 library's geographic service area for whom the library
24 22 provides services.
24 23 c. The amount of other funding the eligible public library
24 24 received in the previous fiscal year for providing services to
24 25 rural residents and to contracting communities.
24 26 3. Moneys received by a public library pursuant to this
24 27 section shall supplement, not supplant, any other funding
24 28 received by the library.
24 29 4. For purposes of this section, "eligible public library"
24 30 means a public library that meets all of the following
24 31 requirements:
24 32 a. Submits to the division all of the following:
24 33 (1) The report provided for under section 256.51,
24 34 subsection 1, paragraph "h".
24 35 (2) An application and accreditation report, in a format
25 1 approved by the commission, that provides evidence of the
25 2 library's compliance with at least one level of the standards
25 3 established in accordance with section 256.51, subsection 1,
25 4 paragraph "k".
25 5 (3) Any other application or report the division deems
25 6 necessary for the implementation of the enrich Iowa program.
25 7 b. Participates in the library resource and information
25 8 sharing programs established by the state library.
25 9 c. Is a public library established by city ordinance or a
25 10 library district as provided in chapter 336.
25 11 5. Each eligible public library shall maintain a separate
25 12 listing within its budget for payments received and
25 13 expenditures made pursuant to this subsection, and shall
25 14 annually submit this listing to the division.
25 15 6. By January 15, annually, the division shall submit a
25 16 program evaluation report to the general assembly and the
25 17 governor detailing the uses and the impacts of funds allocated
25 18 under this section.
25 19 7. A public library that receives funds in accordance with
25 20 this section shall have an internet use policy in place, which
25 21 may or may not include internet filtering. The library shall
25 22 submit a report describing the library's internet use efforts
25 23 to the division.
25 24 8. A public library that receives funds in accordance with
25 25 this section shall provide open access, the reciprocal
25 26 borrowing program, as a service to its patrons, at a
25 27 reimbursement rate determined by the state library.
25 28 9. Funds appropriated for purposes of this section shall
25 29 not be used by the division for administrative purposes.
25 30 Sec. 16. Section 260C.14, Code 2005, is amended by adding
25 31 the following new subsection:
25 32 NEW SUBSECTION. 21. Annually, by October 1, submit to the
25 33 department of education through the management information
25 34 system, at a minimum, in the manner prescribed by the
25 35 department the following information for the previous fiscal
26 1 year:
26 2 a. Total revenue received from each local school district
26 3 as a result of high school students enrolled in community
26 4 college courses under the postsecondary enrollment options
26 5 Act.
26 6 b. Total revenue received from each local school district
26 7 as a result of high school students enrolled in community
26 8 college courses through shared supplementary weighting plans.
26 9 c. Unduplicated headcount of high school students enrolled
26 10 in community college courses under the postsecondary
26 11 enrollment options Act.
26 12 d. Unduplicated headcount of high school students enrolled
26 13 in community college courses through shared supplementary
26 14 weighting plans.
26 15 e. Total credits earned by high school students enrolled
26 16 in community college courses under the postsecondary
26 17 enrollment options Act, broken down by vocational=technical or
26 18 career program and arts and sciences program.
26 19 f. Number of courses in which high school students are
26 20 enrolled under shared supplementary weighting plans and the
26 21 portions of those courses that are taught by an instructor who
26 22 is employed by the local school district for a portion of the
26 23 school day.
26 24 The department of education shall define the annual
26 25 supplemental financial reporting required of all community
26 26 colleges regarding revenues received through the delivery of
26 27 college credit courses to high school students. The board of
26 28 directors of each community college shall incorporate into
26 29 their student management information systems the unique
26 30 student identifier used by school districts as provided by the
26 31 department of education to school districts.
26 32 Sec. 17. Section 261.25, subsection 1, Code Supplement
26 33 2005, is amended to read as follows:
26 34 1. There is appropriated from the general fund of the
26 35 state to the commission for each fiscal year the sum of forty=
27 1 nine forty=six million six five hundred seventy=three six
27 2 thousand five two hundred seventy=five eighteen dollars for
27 3 tuition grants. From the funds appropriated in this
27 4 subsection, an amount equal to ten percent of the funds
27 5 appropriated in this subsection shall be reserved for
27 6 distribution to students attending private institutions whose
27 7 income is not exempt from taxation under section 501(c) of the
27 8 Internal Revenue Code and whose students were eligible to
27 9 receive Iowa tuition grant moneys in the fiscal year beginning
27 10 July 1, 2003. A for=profit institution which, effective March
27 11 9, 2005, purchased an accredited private institution that was
27 12 exempt from taxation under section 501(c) of the Internal
27 13 Revenue Code, shall be an eligible institution under the Iowa
27 14 tuition grant program. In the case of a qualified student who
27 15 was enrolled in such accredited private institution that was
27 16 purchased by the for=profit institution effective March 9,
27 17 2005, and who continues to be enrolled in the eligible
27 18 institution in succeeding years, the amount the student
27 19 qualifies for under this subsection shall be not less than the
27 20 amount the student qualified for in the fiscal year beginning
27 21 July 1, 2004.
27 22 Sec. 18. Section 261.25, Code Supplement 2005, is amended
27 23 by adding the following new subsection:
27 24 NEW SUBSECTION. 1A. There is appropriated from the
27 25 general fund of the state to the commission for each fiscal
27 26 year the sum of five million one hundred sixty=seven thousand
27 27 three hundred fifty=eight dollars for proprietary tuition
27 28 grants.
27 29 Sec. 19. Section 261.111, subsection 5, Code 2005, is
27 30 amended to read as follows:
27 31 5. The annual amount of a teacher shortage forgivable loan
27 32 shall not exceed three thousand dollars annually the resident
27 33 tuition rate established for institutions of higher education
27 34 governed by the state board of regents, or the amount of the
27 35 student's established financial need, whichever is less.
28 1 Sec. 20. Section 261.111, Code 2005, is amended by adding
28 2 the following new subsections:
28 3 NEW SUBSECTION. 9. The commission shall submit in a
28 4 report to the chairpersons and ranking members of the joint
28 5 appropriations subcommittee on education by January 1,
28 6 annually, the number of students who received forgivable loans
28 7 pursuant to this section, which institutions the students were
28 8 enrolled in, and the amount paid to each of the institutions
28 9 on behalf of the students who received forgivable loans
28 10 pursuant to this section.
28 11 NEW SUBSECTION. 10. Moneys appropriated by the general
28 12 assembly for purposes of this section shall be allocated only
28 13 to the extent that the state moneys are matched from other
28 14 sources by the commission on a dollar=for=dollar basis.
28 15 Sec. 21. Section 272.10, Code Supplement 2005, is amended
28 16 to read as follows:
28 17 272.10 FEES.
28 18 1. It is the intent of the general assembly that licensing
28 19 fees established by the board of educational examiners be
28 20 sufficient to finance the activities of the board under this
28 21 chapter.
28 22 2. Licensing fees are payable to the treasurer of state
28 23 and shall be deposited with the executive director of the
28 24 board. The executive director shall deposit twenty=five
28 25 percent of the fees collected annually with the treasurer of
28 26 state and the fees shall be credited to the general fund of
28 27 the state. The remaining licensing fees collected during the
28 28 fiscal year shall be retained by and are appropriated to the
28 29 board for the purposes related to the board's duties.
28 30 Notwithstanding section 8.33, licensing fees retained by and
28 31 appropriated to the board pursuant to this section that remain
28 32 unencumbered or unobligated at the close of the fiscal year in
28 33 an amount of not more than fifteen percent of the total
28 34 licensing fees collected by the board during the fiscal year
28 35 shall not revert but shall remain available for expenditure
29 1 for the activities of the board as provided in this chapter
29 2 until the close of the succeeding fiscal year.
29 3 3. The executive director shall keep an accurate and
29 4 detailed account of fees received and, including fees paid to
29 5 the treasurer of state and fees retained by the board.
29 6 4. The board shall submit a detailed annual financial
29 7 report by January 1 to the chairpersons and ranking members of
29 8 the joint appropriations subcommittee on education and the
29 9 legislative services agency.
29 10 Sec. 22. Section 284.7, unnumbered paragraph 1, Code
29 11 Supplement 2005, is amended to read as follows:
29 12 To promote continuous improvement in Iowa's quality
29 13 teaching workforce and to give Iowa teachers the opportunity
29 14 for career recognition that reflects the various roles
29 15 teachers play as educational leaders, an Iowa teacher career
29 16 path is established for teachers employed by participating
29 17 school districts. A participating school district shall use
29 18 funding allocated under section 284.13, subsection 1,
29 19 paragraph "d" "f", to raise teacher salaries to meet the
29 20 requirements of this section. The Iowa teacher career path
29 21 and salary minimums are as follows:
29 22 Sec. 23. Section 284.7, subsection 6, paragraphs a and b,
29 23 Code Supplement 2005, are amended to read as follows:
29 24 a. If the licensed employees of a school district or area
29 25 education agency receiving funds pursuant to section 284.13,
29 26 subsection 1, paragraph "d" "f" or "e" "g", for purposes of
29 27 this section, are organized under chapter 20 for collective
29 28 bargaining purposes, the board of directors and the certified
29 29 bargaining representative for the licensed employees shall
29 30 mutually agree upon a formula for distributing the funds among
29 31 the teachers employed by the school district or area education
29 32 agency. However, the school district must comply with the
29 33 salary minimums provided for in this section. The parties
29 34 shall follow the negotiation and bargaining procedures
29 35 specified in chapter 20 except that if the parties reach an
30 1 impasse, neither impasse procedures agreed to by the parties
30 2 nor sections 20.20 through 20.22 shall apply and the funds
30 3 shall be paid as provided in paragraph "b". Negotiations
30 4 under this section are subject to the scope of negotiations
30 5 specified in section 20.9. If a board of directors and the
30 6 certified bargaining representative for licensed employees
30 7 have not reached mutual agreement for the distribution of
30 8 funds received pursuant to section 284.13, subsection 1,
30 9 paragraph "d" "f" or "e" "g", by July 15 of the fiscal year
30 10 for which the funds are distributed, paragraph "b" of this
30 11 subsection shall apply.
30 12 b. If, once the minimum salary requirements of this
30 13 section have been met by the school district or area education
30 14 agency, and the school district or area education agency
30 15 receiving funds pursuant to section 284.13, subsection 1,
30 16 paragraph "d" "f" or "e" "g", for purposes of this section,
30 17 and the certified bargaining representative for the licensed
30 18 employees have not reached an agreement for distribution of
30 19 the funds remaining, in accordance with paragraph "a", the
30 20 board of directors shall divide the funds remaining among
30 21 full=time teachers employed by the district or area education
30 22 agency whose regular compensation is equal to or greater than
30 23 the minimum career teacher salary specified in this section.
30 24 The payment amount for teachers employed on less than a full=
30 25 time basis shall be prorated.
30 26 Sec. 24. Section 284.13, subsection 1, Code Supplement
30 27 2005, is amended to read as follows:
30 28 1. For each fiscal year in which moneys are appropriated
30 29 by the general assembly for purposes of the student
30 30 achievement and teacher quality program, the moneys shall be
30 31 allocated as follows in the following priority order:
30 32 a. For the fiscal year beginning July 1, 2005 2006, and
30 33 ending June 30, 2006 2007, to the department of education, the
30 34 amount of two million dollars for the issuance of national
30 35 board certification awards in accordance with section 256.44.
31 1 b. For the fiscal year beginning July 1, 2005, and
31 2 succeeding fiscal years, an amount up to four million two
31 3 hundred thousand dollars for first=year and second=year
31 4 beginning teachers, to the department of education for
31 5 distribution to school districts for purposes of the beginning
31 6 teacher mentoring and induction programs. A school district
31 7 shall receive one thousand three hundred dollars per beginning
31 8 teacher participating in the program. If the funds
31 9 appropriated for the program are insufficient to pay mentors
31 10 and school districts as provided in this paragraph, the
31 11 department shall prorate the amount distributed to school
31 12 districts based upon the amount appropriated. Moneys received
31 13 by a school district pursuant to this paragraph shall be
31 14 expended to provide each mentor with an award of five hundred
31 15 dollars per semester, at a minimum, for participation in the
31 16 school district's beginning teacher mentoring and induction
31 17 program; to implement the plan; and to pay any applicable
31 18 costs of the employer's share of contributions to federal
31 19 social security and the Iowa public employees' retirement
31 20 system or a pension and annuity retirement system established
31 21 under chapter 294, for such amounts paid by the district.
31 22 c. For the fiscal year beginning July 1, 2005 2006, and
31 23 ending June 30, 2006 2007, up to four hundred eighty=five
31 24 thousand dollars to the department of education for purposes
31 25 of implementing the career development program requirements of
31 26 section 284.6, the review panel requirements of section 284.9,
31 27 and the evaluator training program in section 284.10. From
31 28 the moneys allocated to the department pursuant to this
31 29 paragraph, not less than ten thousand dollars shall be
31 30 distributed to the board of educational examiners for purposes
31 31 of convening an educator licensing review working group. From
31 32 the moneys allocated to the department pursuant to this
31 33 paragraph, not less than eighty=five thousand dollars shall be
31 34 used to administer the ambassador to education position in
31 35 accordance with section 256.45. A portion of the funds
32 1 allocated to the department for purposes of this paragraph may
32 2 be used by the department for administrative purposes.
32 3 Notwithstanding section 8.33, moneys allocated for purposes of
32 4 this paragraph prior to July 1, 2004, which remain unobligated
32 5 or unexpended at the end of the fiscal year for which the
32 6 moneys were appropriated, shall remain available for
32 7 expenditure for the purposes for which they were allocated,
32 8 for the fiscal year beginning July 1, 2004, and ending June
32 9 30, 2005.
32 10 d. For each fiscal year in which funds are appropriated
32 11 for purposes of this chapter, the moneys remaining after
32 12 distribution as provided in paragraphs "a" through "c" and "e"
32 13 shall be allocated to school districts for salaries and career
32 14 development in accordance with the following formula:
32 15 (1) Fifty percent of the allocation shall be in the
32 16 proportion that the basic enrollment of a school district
32 17 bears to the sum of the basic enrollments of all school
32 18 districts in the state for the budget year.
32 19 (2) Fifty percent of the allocation shall be based upon
32 20 the proportion that the number of full=time equivalent
32 21 teachers employed by a school district bears to the sum of the
32 22 number of full=time equivalent teachers who are employed by
32 23 all school districts in the state for the base year.
32 24 e. From moneys available under paragraph "d", the
32 25 department shall allocate to area education agencies an amount
32 26 per classroom teacher employed by an area education agency
32 27 that is approximately equivalent to the average per teacher
32 28 amount allocated to the districts. The average per teacher
32 29 amount shall be calculated by dividing the total number of
32 30 classroom teachers employed by school districts and the
32 31 classroom teachers employed by area education agencies into
32 32 the total amount of moneys available under paragraph "d".
32 33 f. d. For the fiscal year beginning July 1, 2005 2006,
32 34 and ending June 30, 2006 2007, up to ten million dollars to
32 35 the department of education for use by school districts to add
33 1 one additional teacher contract day to the school calendar.
33 2 The department shall distribute funds allocated for the
33 3 purpose of this paragraph based on the average per diem
33 4 contract salary for each district as reported to the
33 5 department for the school year beginning July 1, 2004 2005,
33 6 multiplied by the total number of full=time equivalent
33 7 teachers in the base year. The department shall adjust each
33 8 district's average per diem salary by the allowable growth
33 9 rate established under section 257.8 for the fiscal year
33 10 beginning July 1, 2005 2006. The contract salary amount shall
33 11 be the amount paid for their regular responsibilities but
33 12 shall not include pay for extracurricular activities. A
33 13 school district shall submit a report to the department in a
33 14 manner determined by the department describing its use of the
33 15 funds received under this paragraph. The department shall
33 16 submit a report on school district use of the moneys
33 17 distributed pursuant to this paragraph to the chairpersons and
33 18 ranking members of the house and senate standing committees on
33 19 education, the joint appropriations subcommittee on education,
33 20 and the legislative services agency not later than January 15,
33 21 2006 2007.
33 22 g. e. For the fiscal year beginning July 1, 2005 2006,
33 23 and ending June 30, 2006 2007, up to six million six hundred
33 24 twenty=five thousand dollars to the department of education
33 25 for use by school districts for either salaries or
33 26 professional development, or both, as determined by the school
33 27 district. Funds received by a school district for purposes of
33 28 this paragraph shall be distributed using the formula provided
33 29 in paragraph "d" and are subject to the provisions of section
33 30 284.7, subsection 6 "f". A school district shall submit a
33 31 report to the department in a manner determined by the
33 32 department describing its use of the funds received under this
33 33 paragraph. The department shall submit a report on school
33 34 district use of the funds distributed pursuant to this
33 35 paragraph to the chairpersons and ranking members of the house
34 1 and senate standing committees on education, the joint
34 2 appropriations subcommittee on education, and the legislative
34 3 services agency not later than January 15, 2006 annually. The
34 4 provisions of section 284.7, subsection 6 do not apply to this
34 5 paragraph.
34 6 f. For each fiscal year in which funds are appropriated
34 7 for purposes of this chapter, the moneys remaining after
34 8 distribution as provided in paragraphs "a" through "e" shall
34 9 be allocated to school districts for salaries and career
34 10 development in accordance with the following formula:
34 11 (1) Fifty percent of the allocation shall be in the
34 12 proportion that the basic enrollment of a school district
34 13 bears to the sum of the basic enrollments of all school
34 14 districts in the state for the budget year.
34 15 (2) Fifty percent of the allocation shall be based upon
34 16 the proportion that the number of full=time equivalent
34 17 teachers employed by a school district bears to the sum of the
34 18 number of full=time equivalent teachers who are employed by
34 19 all school districts in the state for the base year.
34 20 g. From moneys available under paragraph "f", the
34 21 department shall allocate to area education agencies an amount
34 22 per classroom teacher employed by an area education agency
34 23 that is approximately equivalent to the average per teacher
34 24 amount allocated to the districts. The average per teacher
34 25 amount shall be calculated by dividing the total number of
34 26 classroom teachers employed by school districts and the
34 27 classroom teachers employed by area education agencies into
34 28 the total amount of moneys available under paragraph "f".
34 29 h. Notwithstanding section 8.33, any moneys remaining
34 30 unencumbered or unobligated from the moneys allocated for
34 31 purposes of paragraph "a", or "b", or "c" shall not revert but
34 32 shall remain available in the succeeding fiscal year for
34 33 expenditure for the purposes designated. The provisions of
34 34 section 8.39 shall not apply to the funds appropriated
34 35 pursuant to this subsection.
35 1 Sec. 25. Section 284.13, subsection 2, Code Supplement
35 2 2005, is amended to read as follows:
35 3 2. A school district that is unable to meet the provisions
35 4 of section 284.7, subsection 1, with funds allocated pursuant
35 5 to subsection 1, paragraph "d" "f", may request a waiver from
35 6 the department to use funds appropriated under chapter 256D to
35 7 meet the provisions of section 284.7, subsection 1, if the
35 8 difference between the funds allocated to the school district
35 9 pursuant to subsection 1, paragraph "d" "f", and the amount
35 10 required to comply with section 284.7, subsection 1, is not
35 11 less than ten thousand dollars. The department shall consider
35 12 the average class size of the school district, the school
35 13 district's actual unspent balance from the preceding year, and
35 14 the school district's current financial position.
35 15 Sec. 26. FUTURE EFFECTIVE DATE. The section of this Act,
35 16 that amends section 260C.14, takes effect July 1, 2008.

35 18 2005=2006 TECHNICAL CORRECTION
35 19 STATE PROGRAM ALLOCATION FORMULA
35 20 Sec. 27. Section 284.13, subsection 1, paragraph d,
35 21 unnumbered paragraph 1, Code Supplement 2005, is amended to
35 22 read as follows:
35 23 d. For each fiscal year in which funds are appropriated
35 24 for purposes of this chapter, the moneys remaining after
35 25 distribution as provided in paragraphs "a" through "c", "f",
35 26 and "e" "g" shall be allocated to school districts for
35 27 salaries and career development in accordance with the
35 28 following formula:
35 29 Sec. 28. EFFECTIVE AND RETROACTIVE APPLICABILITY DATES.
35 30 The section of this division of this Act amending section
35 31 284.13, subsection 1, paragraph "d", unnumbered paragraph 1,
35 32 being deemed of immediate importance, takes effect upon
35 33 enactment and applies retroactively to July 1, 2005, for the
35 34 fiscal year beginning July 1, 2005, and ending June 30, 2006.
35 35 EXPLANATION
36 1 This bill appropriates moneys for fiscal year 2006=2007
36 2 from the general fund of the state to the college student aid
36 3 commission, the department for the blind, the department of
36 4 cultural affairs, the department of education, and the state
36 5 board of regents and its institutions.
36 6 The bill appropriates to the department for the blind for
36 7 its administration.
36 8 The bill includes appropriations to the college student aid
36 9 commission for general administrative purposes, student aid
36 10 programs, an initiative directing primary care physicians to
36 11 areas of the state experiencing physician shortages,
36 12 forgivable loans for Des Moines university == osteopathic
36 13 medical center students, the national guard educational
36 14 assistance program, and the teacher shortage forgivable loan
36 15 program the registered nurse recruitment program, and for
36 16 state of Iowa scholarships. The appropriations for the state
36 17 of Iowa scholarships, teacher shortage forgivable loans, and
36 18 registered nurse recruitment programs must be matched on a $1=
36 19 for=$1 basis. The bill reduces the $2.75 million standing
36 20 appropriation for the Iowa work=study program for fiscal year
36 21 2006=2007 to $140,000. The bill amends the tuition grant
36 22 standing appropriation to reduce the funding to provide a
36 23 standing appropriation for proprietary tuition grants.
36 24 The bill appropriates to the department of cultural affairs
36 25 for its arts, historical and administration divisions, for
36 26 historic sites, and for community cultural grants.
36 27 The bill appropriates moneys to the department of education
36 28 for purposes of the department's general administration,
36 29 vocational education administration, division of vocational
36 30 rehabilitation services, independent living, state library for
36 31 general administration and the enrich Iowa program, library
36 32 service area system, public broadcasting division, regional
36 33 telecommunications councils, vocational education to secondary
36 34 schools, school food service, Iowa empowerment fund, textbooks
36 35 for nonpublic school pupils, student achievement and teacher
37 1 quality program, vocational agriculture youth organizations,
37 2 and community colleges. The bill makes technical changes
37 3 related to the allocations provided in statute for the student
37 4 achievement and teacher quality program appropriation. The
37 5 bill permits the board of educational examiners to retain 75
37 6 percent of the fees collected.
37 7 The bill appropriates moneys to the state board of regents
37 8 for the board office, for tuition replacement, universities'
37 9 general operating budgets, the southwest Iowa graduate studies
37 10 center, the tristate graduate center, the quad=cities graduate
37 11 studies center, Iowa's obligation as a member of the
37 12 midwestern higher education compact, the state university of
37 13 Iowa, Iowa state university of science and technology, the
37 14 university of northern Iowa, the Iowa school for the deaf, the
37 15 Iowa braille and sight saving school, and for tuition and
37 16 transportation costs for students residing in the Iowa braille
37 17 and sight saving school, and the Iowa school for the deaf.
37 18 The bill includes a directive for the departments and
37 19 independent agencies receiving an appropriation in the bill to
37 20 review employee policy for daily or short=term travel and to
37 21 implement policy revisions to maximize cost savings. The
37 22 directive includes requirements for reporting to the
37 23 committees on government oversight.
37 24 The bill provides for effective and retroactive
37 25 applicability dates for technical corrections to the
37 26 allocation formula for teacher salaries and career
37 27 development.
