  1  1    Section 1.  Section 321.208, subsection 2, unnumbered
  1  2 paragraph 1, Code Supplement 2005, is amended to read as
  1  3 follows:
  1  4    A person is disqualified from operating a commercial motor
  1  5 vehicle for one year upon a conviction or final administrative
  1  6 decision that the person has committed any of the following
  1  7 acts or offenses in any state or foreign jurisdiction while
  1  8 operating a commercial motor vehicle or while operating a
  1  9 noncommercial motor vehicle and holding a commercial driver's
  1 10 license:
  1 11    Sec. 2.  Section 321.208, subsection 2, paragraph a, Code
  1 12 Supplement 2005, is amended to read as follows:
  1 13    a.  Operating a commercial motor vehicle while under the
  1 14 influence of an alcoholic beverage or other drug or controlled
  1 15 substance or a combination of such substances.
  1 16                           EXPLANATION
  1 17    This bill revises the grounds for disqualification from
  1 18 operating a commercial motor vehicle.  Current law provides
  1 19 that certain offenses committed while operating either a
  1 20 commercial motor vehicle or a noncommercial motor vehicle
  1 21 while holding a commercial driver's license are grounds for
  1 22 disqualification from operating a commercial motor vehicle for
  1 23 one year.  Those offenses include operating while intoxicated,
  1 24 refusal to submit to chemical testing, leaving the scene of an
  1 25 accident, and certain felonies or aggravated misdemeanors
  1 26 involving the use of a motor vehicle.  The bill provides that
  1 27 the commission of such an offense while operating a
  1 28 noncommercial motor vehicle does not disqualify a person from
  1 29 operating a commercial motor vehicle.
