1 An Act relating to the public exposure of certain body parts of a
2 person, and providing a penalty.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. NEW SECTION. 723.5 PUBLIC EXPOSURE.
1 2 1. A person shall not expose the following parts of the
1 3 person's body to another person in a public place or in a
1 4 place that can be seen by another person in a public place:
1 5 a. The person's genitals, pubes, perineum, or anus.
1 6 b. If the person is female, the person's nipple or areola.
1 7 2. Subsection 1, paragraph "b", does not apply to a woman
1 8 breast=feeding the woman's own child in any place where the
1 9 woman's presence is otherwise authorized.
1 10 3. This section does not apply to the public exposure of a
1 11 prepubescent minor's body parts.
1 12 4. This section does not apply to minimal exposures when
1 13 using a public restroom, locker room, or in other places where
1 14 the exposure of body parts listed in subsection 1 may lawfully
1 15 occur, including a theater, concert hall, art center, museum,
1 16 or similar establishment which is primarily devoted to the
1 17 arts or theatrical performances and in which any of the
1 18 circumstances contained in this section are permitted or
1 19 allowed as part of such art exhibits or performances.
1 20 5. A person who violates this section commits a serious
1 21 misdemeanor.
1 22 EXPLANATION
1 23 This bill relates to the public exposure of certain body
1 24 parts of a person.
1 25 The bill provides that a person shall not expose the
1 26 person's genitals, pubes, perineum, or anus to another person
1 27 in a public place or from a place where another person in a
1 28 public place can view the exposure. The bill also prohibits
1 29 the public exposure of a female nipple or areola except when
1 30 breast=feeding.
1 31 The bill does not apply to public exposures by prepubescent
1 32 minors. The bill also does not apply to minimal public
1 33 exposures in a restroom, locker room, or in other places where
1 34 the exposure of body parts may lawfully occur, including a
1 35 theater, concert hall, art center, museum, or similar
2 1 establishment which is primarily devoted to the arts or
2 2 theatrical performances and in which any of the circumstances
2 3 contained in this section are permitted or allowed as part of
2 4 such art exhibits or performances.
2 5 A person who violates the bill commits a serious
2 6 misdemeanor.
