1 An Act relating to a substitute teaching authorization for
2 persons holding a license or certificate to teach issued by
3 another state.

1 1 Section 1. Section 272.8, Code 2005, is amended to read as
1 2 follows:
1 3 272.8 LICENSE TO APPLICANTS FROM OTHER STATES OR
1 4 COUNTRIES.
1 5 1. The board may issue a license to an applicant from
1 6 another state or country if the applicant files evidence of
1 7 the possession of the required or equivalent requirements with
1 8 the board.
1 9 2. Upon written application by a school district or
1 10 accredited nonpublic school on behalf of a person who holds a
1 11 valid teaching license or certificate from another state and
1 12 whom the school district or accredited nonpublic school
1 13 intends to employ as a substitute teacher, the board shall
1 14 authorize the person to be employed as a substitute teacher by
1 15 a school district or accredited nonpublic school in this state
1 16 for not more than ninety instructional days during any one
1 17 school year. An applicant issued authorization as provided in
1 18 this subsection shall comply with and be subject to rules
1 19 adopted by the board pursuant to section 272.2 relating to a
1 20 code of professional rights and responsibilities, practices,
1 21 and ethics. The board may initiate disciplinary actions as
1 22 provided in section 272.2, subsection 4, hear appeals as
1 23 provided in section 272.2, subsection 8, and revoke or suspend
1 24 an authorization issued under this subsection as it would for
1 25 a person holding a substitute teacher license. Rules adopted
1 26 pursuant to section 272.2, subsection 14, shall apply to an
1 27 applicant issued an authorization in accordance with this
1 28 subsection.
1 29 3. The executive director of the board may, subject to
1 30 board approval, enter into reciprocity agreements with another
1 31 state or country for the licensing of practitioners on an
1 32 equitable basis of mutual exchange, when the action is in
1 33 conformity with law.
1 34 4. Practitioner preparation and professional development
1 35 programs offered in this state by out=of=state institutions
2 1 must be approved by the board in order to fulfill requirements
2 2 for licensure or renewal of a license by an applicant.
2 3 EXPLANATION
2 4 This bill directs the board of educational examiners to
2 5 authorize a person who is licensed or certified to teach in a
2 6 another state to substitute teach for not more than 90
2 7 instructional days per school year if a school district or
2 8 accredited nonpublic school which intends to employ the person
2 9 applies for board authorization on behalf of the person. A
2 10 person who receives authorization must comply with the board's
2 11 rules regarding a code of professional rights and
2 12 responsibilities, practices, and ethics. The board may
2 13 initiate disciplinary actions, hear appeals, and revoke or
2 14 suspend an authorization as it would for a person holding a
2 15 substitute teacher license. Also, rules adopted by the board
2 16 relating to denial or revocation of a license upon the board's
2 17 finding by a preponderance of evidence that the person has
2 18 been convicted of a crime or that there has been a founded
2 19 report of child abuse against the person shall apply to the
2 20 person.
