Section 135.105, Code 2005, is amended by 1 2 adding the following new subsection: 1 3 NEW SUBSECTION. 3. Administer the lead abatement program 1 4 pursuant to section 135.105D. 1 5 Sec. 2. NEW SECTION. 135.105D LEAD ABATEMENT PROGRAM == 1 6 FUND ESTABLISHED == APPROPRIATION. 1 7 1. The department shall establish and administer a lead 1 8 abatement program. The purpose of the program shall be to 1 9 provide funding for lead abatement projects and efforts which 1 10 involve the direct removal of lead=based paint from 1 11 residential dwellings. Funds appropriated pursuant to 1 12 subsection 2 shall be allocated by the department on a fifty 1 13 percent urban, fifty percent rural geographic basis, with 1 14 funds targeted toward areas determined by the department to 1 15 represent the highest density of residential lead paint 1 16 concentration within urban and rural areas across the state. 1 17 The department shall by rule establish selection criteria for 1 18 the awarding of funds, standards regarding evaluation of 1 19 potential recipients of lead abatement funding and relative 1 20 density of residential lead paint concentrations, and 1 21 procedures for coordination with certified lead inspectors and 1 22 abaters regarding lead abatement efforts. 1 23 2. A lead abatement program fund is created in the state 1 24 treasury under the control of the department. There is 1 25 appropriated annually from the general fund of the state to 1 26 the lead abatement program fund one million dollars, or so 1 27 much thereof as is necessary, for administering the lead 1 28 abatement program. Notwithstanding section 8.33, any balance 1 29 in the fund on June 30 of each fiscal year shall not revert to 1 30 the general fund of the state, but shall remain available in 1 31 subsequent fiscal years. Notwithstanding section 12C.7, 1 32 subsection 2, interest or earnings on moneys deposited in the 1 33 fund shall be credited to the fund. 1 34 3. Funds appropriated pursuant to this section shall 1 35 supplement, and not supplant, any other federal or state funds 2 1 received by the department for lead abatement efforts, and 2 2 shall not be allocated by the department for lead poisoning 2 3 education efforts or for the childhood lead poisoning 2 4 prevention program established in section 135.103. The 2 5 department shall submit a report to the general assembly by 2 6 January 1 annually regarding utilization of the appropriated 2 7 funds and the results of the program. 2 8 EXPLANATION 2 9 This bill establishes a lead abatement program to be 2 10 administered by the Iowa department of public health. The 2 11 objective of the program is to provide funding for the direct 2 12 removal of lead=based paint from residential dwellings. The 2 13 bill directs the department to allocate appropriated funds on 2 14 a 50 percent urban, 50 percent rural basis, to areas 2 15 determined by the department to represent the highest density 2 16 of residential lead paint concentration. The bill provides 2 17 that the department shall by rule establish selection criteria 2 18 for the awarding of funds, standards for evaluation of 2 19 potential recipients of lead abatement funding and density 2 20 levels, and procedures for coordination with certified lead 2 21 inspectors and abaters regarding lead abatement efforts. 2 22 The bill establishes a lead abatement program fund in the 2 23 office of the treasurer of state, under the control of the 2 24 department, and annually appropriates from the general fund of 2 25 the state to the program $1 million for the use of the 2 26 department in administering the lead abatement program. The 2 27 bill includes nonreversionary language and provides that 2 28 interest or earnings on moneys deposited in the fund shall be 2 29 credited to the fund. The bill states that the appropriated 2 30 funds are intended to supplement, not supplant, any other 2 31 federal or state funds received for lead abatement efforts, 2 32 and that they shall not be allocated for lead poisoning 2 33 education efforts or the childhood lead poisoning prevention 2 34 program established in Code section 135.103.
