1 1 Section 1. Section 384.6, subsection 1, Code 2005, is
1 2 amended to read as follows:
1 3 1. Accounting for pension and related employee benefit
1 4 funds as provided by the city finance committee. A city may
1 5 certify taxes to be levied for a trust and agency fund in the
1 6 amount necessary to meet its obligations.
1 7 a. A city may make contributions to a retirement system
1 8 other than the Iowa public employees' retirement system for
1 9 its city manager, or city administrator performing the duties
1 10 of city manager, in an annual amount not to exceed the amount
1 11 that would have been contributed by the employer under section
1 12 97B.11.
1 13 b. If a police chief or fire chief has submitted a written
1 14 request to the board of trustees to be exempt from chapter
1 15 411, authorized in section 411.3, subsection 1, a city shall
1 16 make contributions for the chief, in an amount not to exceed
1 17 the amount that would have been contributed by the city under
1 18 section 411.8, subsection 1, paragraph "a", to the
1 19 international city management association/retirement
1 20 corporation. A city may certify taxes to be levied for a
1 21 trust and agency fund in the amount necessary to meet its
1 22 obligations.
1 23 c. A city which has contracted with another city or
1 24 governmental entity for the provision of public safety
1 25 services, including but not limited to police protection, fire
1 26 protection, ambulance, or hazardous materials response, may,
1 27 pursuant to contract, make contributions for pension and
1 28 related employee benefits for personnel of the other city or
1 29 governmental entity providing such services to the city. The
1 30 city may make such contributions in an annual amount not to
1 31 exceed the amount of contributions for pension and related
1 32 employee benefits that would otherwise be paid by the other
1 33 city or governmental entity for such personnel.
1 34 EXPLANATION
1 35 A city may establish trust and agency funds to account for
2 1 the payment of pension and related employee benefits. Under
2 2 current law, a city may make contributions to alternate
2 3 retirement systems for city managers or administrators and for
2 4 city police or fire chiefs, not to exceed the amount the city
2 5 would have otherwise contributed on behalf of such personnel.
2 6 This bill allows a city to contribute to pension and
2 7 related employee benefits for personnel of another city or
2 8 governmental entity pursuant to a contract in which the city
2 9 receives public safety services, including but not limited to
2 10 police protection, fire protection, ambulance, or hazardous
2 11 materials response, from the other city or governmental
2 12 entity. The city may make such contributions in an annual
2 13 amount not to exceed the amount of contributions for pension
2 14 and related employee benefits that would otherwise be paid by
2 15 the other city or governmental entity for such personnel.
