1 An Act requiring the state and political subdivisions to appoint
2 gender=balanced boards, commissions, committees, and councils.

1 1 Section 1. Section 69.16A, Code 2005, is amended to read
1 2 as follows:
1 3 69.16A GENDER BALANCE.
1 4 All appointive boards, commissions, committees, and
1 5 councils of the state established by the Code or of a
1 6 political subdivision if not otherwise provided by law shall
1 7 be gender balanced. No person shall be appointed or
1 8 reappointed to any board, commission, committee, or council
1 9 established by the Code if that appointment or reappointment
1 10 would cause the number of members of the board, commission,
1 11 committee, or council of one gender to be greater than one=
1 12 half the membership of the board, commission, committee, or
1 13 council plus one if the board, commission, committee, or
1 14 council is composed of an odd number of members. If the
1 15 board, commission, committee, or council is composed of an
1 16 even number of members, not more than one=half of the
1 17 membership shall be of one gender. If there are multiple
1 18 appointing authorities for a board, commission, committee, or
1 19 council, they shall consult each other to avoid a violation of
1 20 this section. This section shall not prohibit an individual
1 21 from completing a term being served on June 30, 1987 2006.
1 22 For purposes of this section, "political subdivision" means a
1 23 city, county, or school corporation.
1 24 EXPLANATION
1 25 Under current law, all appointive boards, commissions,
1 26 committees, and councils of the state established by the Code
1 27 must be gender balanced. This bill requires all appointive
1 28 boards, commissions, committees, and councils of the state or
1 29 of a political subdivision (i.e., a city, county, or school
1 30 corporation) to be gender balanced.
