1 1 Section 1. Section 237A.13, Code 2005, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 5A. The department shall implement a
1 4 transitional eligibility period provision that is applicable
1 5 unless a waiting list is in effect for the state child care
1 6 assistance program. Under the provision, if a family would
1 7 become ineligible for the program due to excess earned income,
1 8 the family shall remain eligible for an additional six=month
1 9 period in accordance with this subsection. If during the six=
1 10 month transitional eligibility period, the family's monthly
1 11 income again falls within the program's income eligibility
1 12 requirements, the family shall resume participation under the
1 13 program's regular requirements and remains eligible for a
1 14 subsequent six=month transitional eligibility period.
1 15 Otherwise, each month of the six=month transitional
1 16 eligibility period that the family's earned income remains in
1 17 excess of regular program eligibility requirements, the half=
1 18 day copayment amount applicable to the family shall be
1 19 increased by one standard increment above the half=day
1 20 copayment amount applicable to the family in the previous
1 21 month. The incremental increases in the half=day copayment
1 22 amount shall be suspended at the point the family's half=day
1 23 copayment amount is equal to the maximum copayment amount
1 24 applied under the program's regular income requirements.
1 25 EXPLANATION
1 26 This bill relates to the state child care assistance
1 27 program under Code section 237A.13 by directing the department
1 28 of human services to implement a six=month transitional
1 29 eligibility period provision. The provision applies unless a
1 30 waiting list requirement is in effect for the program.
1 31 A family remains eligible for the transitional period if
1 32 the family's earned income exceeds the program's eligibility
1 33 requirements. Each month the family's income remains in
1 34 excess of the eligibility requirements, the half=day copayment
1 35 amount increases by one standard increment until the amount
2 1 reaches the regular program's maximum copayment amount. If
2 2 during a transitional period the family's income again falls
2 3 within the program's eligibility requirements, the family
2 4 resumes participation under the program's regular requirements
2 5 and remains eligible for a subsequent six=month transitional
2 6 eligibility period.
