  1  1    Section 1.  INSTITUTE FOR TOMORROW'S WORKFORCE.  There is
  1  2 appropriated from the general fund of the state to the
  1  3 department of management for allocation to the institute for
  1  4 tomorrow's workforce created under chapter 7K, for the fiscal
  1  5 year beginning July 1, 2006, and ending June 30, 2007, the
  1  6 following amount, or so much thereof as is necessary, to be
  1  7 used for the purposes designated:
  1  8    For the activities of the institute created pursuant to
  1  9 section 7K.1, subject to the matching fund requirement of that
  1 10 section, and as provided in this section:
  1 11 .................................................. $  1,050,000
  1 12    The funds appropriated in this section shall be allocated
  1 13 as follows:
  1 14    1.  The amount of $250,000 for support of the operations
  1 15 and activities of the institute.
  1 16    2.  The amount of $300,000 to determine, in consultation
  1 17 with education stakeholders and professional consultants, the
  1 18 content area knowledge and skills and assessments necessary to
  1 19 measure the content and skills to prepare Iowa learners for
  1 20 the demands of the 21st century.
  1 21    3.  The amount of $500,000 to conduct an independent and
  1 22 thorough study of the current financing for pre=kindergarten,
  1 23 kindergarten through grade 12, and community colleges in order
  1 24 to develop adequate financial support for a performance=based
  1 25 education system.  The study shall include a review of the
  1 26 current taxing structures; address the adequacy, fairness, and
  1 27 flexibility of current funding levels; and consider the
  1 28 adoption of the national average for per=pupil funding.
  1 29    4.  The institute shall submit its findings and
  1 30 recommendations, including proposed legislation, resulting
  1 31 from the review and study conducted pursuant to subsections 2
  1 32 and 3 in a report to the chairpersons and ranking members of
  1 33 the joint appropriations subcommittee on education by January
  1 34 15, 2007.
  1 35    5.  The institute shall coordinate and deploy a public
  2  1 relations campaign, in cooperation with the department of
  2  2 education, the state board of regents, the private sector,
  2  3 and, as possible, with other state or national initiatives, to
  2  4 heighten citizen awareness of the critical need for education
  2  5 improvements in Iowa.  The campaign may involve the advocacy
  2  6 and resources of business, research, and education.  The
  2  7 campaign shall involve media, forums, focus groups, polling
  2  8 and town meetings, and networks of organizations and
  2  9 associations.
  2 10    Sec. 2.  DEPARTMENT OF MANAGEMENT == EDUCATIONAL DELIVERY
  2 11 SYSTEM COMMISSION.  There is appropriated from the general
  2 12 fund of the state to the department of management for the
  2 13 fiscal year beginning July 1, 2006, and ending June 30, 2007,
  2 14 the following amount, or so much thereof as is necessary, to
  2 15 be used for the purposes designated:
  2 16    For the activities and operations of the educational
  2 17 delivery system commission established pursuant to this
  2 18 section:
  2 19 .................................................. $  1,250,000
  2 20    1.  An educational delivery system commission is
  2 21 established to create a plan for a performance=based
  2 22 proficiency system in which learners from prekindergarten
  2 23 through postsecondary progress at their own rate regardless of
  2 24 age and demonstrate proficiency through their skills and
  2 25 knowledge.  The plan shall address the changes required to
  2 26 establish a performance=based, learner=centered educational
  2 27 delivery system, including but not limited to the realignment
  2 28 of school districts, area education agencies, state
  2 29 postsecondary institutions, and the department of education;
  2 30 and the specific quantitative and qualitative indicators and
  2 31 recommendations on management, governance, faculty salaries,
  2 32 services, boundaries, funding, optimum size and administrative
  2 33 efficiencies.
  2 34    2.  The commission shall be composed of fourteen members
  2 35 appointed as follows:
  3  1    a.  One member appointed by the governor.
  3  2    b.  The director of the department of education or the
  3  3 director's designee.
  3  4    c.  The chairperson of the state board of regents or the
  3  5 chairperson's designee.
  3  6    d.  One member appointed by the Iowa association of
  3  7 community college trustees.
  3  8    e.  One member appointed by the Iowa association of
  3  9 community college presidents.
  3 10    f.  One member appointed by the area education agencies.
  3 11    g.  One member appointed by the Iowa state education
  3 12 association.
  3 13    h.  One legislative member appointed by the president of
  3 14 the senate, after consultation with the majority leader of the
  3 15 senate.
  3 16    i.  One legislative member appointed by the minority leader
  3 17 of the senate.
  3 18    j.  One legislative member appointed by the speaker of the
  3 19 house of representatives.
  3 20    k.  One legislative member appointed by the minority leader
  3 21 of the house of representatives.
  3 22    l.  One member appointed by the Iowa association of school
  3 23 boards.
  3 24    m.  One member appointed by the school administrators of
  3 25 Iowa.
  3 26    n.  One member appointed by the Iowa association of
  3 27 business and industry.
  3 28    3.  The commission shall submit its plan, including
  3 29 proposed changes to the Code of Iowa and administrative rules
  3 30 needed to implement the plan, to the general assembly by
  3 31 January 15, 2007.  The general assembly may approve or reject
  3 32 the plan, but shall not amend or modify the plan.  If the
  3 33 general assembly and the governor approve the plan, the plan
  3 34 shall take effect July 1, 2009.
  3 35    Sec. 3.  STUDENT ACHIEVEMENT AND TEACHER QUALITY PROGRAM.
  4  1 There is appropriated from the general fund of the state to
  4  2 the department of education for each fiscal year in the fiscal
  4  3 period beginning July 1, 2006, and ending June 30, 2008, the
  4  4 following amounts, or so much thereof as is necessary, to be
  4  5 used for the purposes designated:
  4  6    For purposes of the student achievement and teacher quality
  4  7 program established pursuant to chapter 284:
  4  8 FY 2006=2007...................................... $177,250,000
  4  9 FY 2007=2008...................................... $327,250,000
  4 10    Sec. 4.  Section 256.7, subsection 26, Code Supplement
  4 11 2005, is amended to read as follows:
  4 12    26.  Develop Adopt rules requiring school districts and
  4 13 accredited nonpublic schools to offer a core curriculum.  The
  4 14 state board shall develop a model core curriculum, taking into
  4 15 consideration the recommendations of the American college
  4 16 testing program, inc.  The state board shall set a goal of
  4 17 increasing the number of students graduating from secondary
  4 18 school who have successfully completed a core curriculum, by
  4 19 July 1, 2009, to eighty percent of all students graduating
  4 20 from secondary schools in this state, except that the goal
  4 21 shall be exclusive of students who have special or alternative
  4 22 means for satisfying graduation requirements under
  4 23 individualized educational plans developed for the students.
  4 24 The state board shall offer materials and support to school
  4 25 districts and accredited nonpublic schools designed to
  4 26 increase the number of students taking the complete American
  4 27 college testing program, inc., college entrance examination,
  4 28 including the writing test, and shall establish a goal of
  4 29 increasing the number of students statewide taking the
  4 30 examination to fifty percent of the senior high school
  4 31 students enrolled in school districts and accredited nonpublic
  4 32 schools throughout the state.  The state board shall also
  4 33 establish a goal of maintaining the statewide average score on
  4 34 the examination at not less than twenty=two.  For purposes of
  4 35 this section, "core curriculum" means the minimum number of
  5  1 specific high school courses that a student needs to take in
  5  2 preparation for advanced career and vocational purposes.
  5  3    Sec. 5.  Section 262.9, Code Supplement 2005, is amended by
  5  4 adding the following new subsection:
  5  5    NEW SUBSECTION.  31.  Adopt rules establishing
  5  6 performance=based proficiencies as the primary determiner of
  5  7 entry and enrollment, and requiring the institutions of higher
  5  8 education under its control to accept the performance=based
  5  9 proficiencies as the primary determiner of entry and
  5 10 enrollment requirements by July 1, 2010.  The board shall also
  5 11 establish high postsecondary graduation and student retention
  5 12 rates for all of the institutions of higher education under
  5 13 its control.
  5 14    Sec. 6.  DEPARTMENT OF EDUCATION TEACHER SALARY STUDY.  The
  5 15 department of education shall conduct a study of teacher
  5 16 salaries, including the minimum level necessary to recruit and
  5 17 retain quality teachers and the salary levels necessary to
  5 18 move this state to the national average in teacher's salary
  5 19 paid.  The department shall develop a plan to increase teacher
  5 20 salaries which shall include a market factor that allows
  5 21 school districts to attract teachers in geographic, socio=
  5 22 economic, and subject=area shortage areas.  The plan shall
  5 23 recognize geographic wage differentials and recommend
  5 24 incentives for traditionally hard=to=staff schools, subject=
  5 25 area shortages, and for improving the racial and ethnic
  5 26 diversity in school district teaching staffs.  The department
  5 27 shall submit its plan, including recommendations for proposed
  5 28 legislation, in a report to the chairpersons and ranking
  5 29 members of the joint appropriations subcommittee on education
  5 30 by January 15, 2007.
  5 31    Sec. 7.  STATE BOARD OF REGENTS == PERFORMANCE=BASED
  5 32 PROFICIENCIES ADMISSIONS == STRATEGY.  The rules relating to
  5 33 the use of performance=based proficiencies adopted by the
  5 34 state board of regents pursuant to section 262.9, subsection
  5 35 31, if enacted by this Act, shall meet or exceed the
  6  1 provisions of administrative rule 681 IAC 1.1(1) in effect on
  6  2 January 1, 2006.  The state board of regents shall develop a
  6  3 five=year strategy for replacing class rank and grade=point
  6  4 averages as basic indicators of college readiness with the
  6  5 performance=based proficiencies adopted pursuant to section
  6  6 262.9, subsection 31, if enacted by this Act.  The board shall
  6  7 submit the strategy to the chairpersons and ranking members of
  6  8 the senate and house of representatives standing committees on
  6  9 education by January 15, 2007.
  6 10    Sec. 8.  POSTSECONDARY COMPETITIVE SALARIES STUDY.  The
  6 11 state board of regents, in cooperation with the department of
  6 12 education, shall convene a working group to study
  6 13 postsecondary faculty salaries paid in community colleges and
  6 14 state universities throughout the state.  The department of
  6 15 education shall provide, at the request of the state board of
  6 16 regents, information and assistance as necessary.  The study
  6 17 shall compare postsecondary faculty salaries paid at public
  6 18 colleges and universities in Iowa with those paid by public
  6 19 colleges and universities in neighboring states and throughout
  6 20 the country.  The study shall review the effects competitive
  6 21 salaries and compensation packages have on the recruitment and
  6 22 retention of faculty and students and shall consider what
  6 23 levels of compensation are best for recruiting and retaining
  6 24 faculty.  The state board of regents shall submit its findings
  6 25 and recommendations in a report to the chairpersons and
  6 26 ranking members of the joint appropriations subcommittee on
  6 27 education by January 15, 2007.
  6 28                           EXPLANATION
  6 29    This bill relates to the recommendations of the institute
  6 30 for tomorrow's workforce and makes appropriations from the
  6 31 general fund of the state for FY 2006=2007 to the department
  6 32 of management for purposes of the institute and for purposes
  6 33 of an educational delivery system commission established under
  6 34 the bill, and to the department of education for FY 2006=2007
  6 35 and FY 2007=2008 for the student achievement and teacher
  7  1 quality program.
  7  2    INSTITUTE FOR TOMORROW'S WORKFORCE.  The bill provides
  7  3 $250,000 for support of the operations and activities of the
  7  4 institute, $300,000 to determine the content area knowledge
  7  5 and skills and assessments necessary to measure the content
  7  6 and skills to prepare Iowa learners for the demands of the
  7  7 21st Century, and $500,000 to conduct a study of the current
  7  8 financing for pre=k=14 in order to develop adequate financial
  7  9 support for a performance=based system.  The bill requires
  7 10 that the institute submit its findings and recommendations in
  7 11 a report to the chairpersons and ranking members of the joint
  7 12 appropriations subcommittee on education by January 15, 2007.
  7 13 Statute requires that moneys appropriated to the institute be
  7 14 matched on a $1=for=$1 basis.
  7 15    The institute is also directed to coordinate and deploy a
  7 16 public relations campaign to heighten citizen awareness of the
  7 17 critical need for education improvements in Iowa.
  7 18    DEPARTMENT OF MANAGEMENT == EDUCATIONAL DELIVERY SYSTEM
  7 19 COMMISSION.  The bill appropriates $1.25 million for the
  7 20 activities and operations of an educational delivery system
  7 21 commission established under the bill.  The commission is
  7 22 directed to develop a plan addressing the changes required to
  7 23 establish a performance=based, learner=centered educational
  7 24 delivery system, including but not limited to the realignment
  7 25 of school districts, area education agencies, state
  7 26 postsecondary institutions, and the department of education;
  7 27 and the specific quantitative and qualitative indicators and
  7 28 recommendations on management, governance, faculty salaries,
  7 29 services, boundaries, funding, optimum size, and
  7 30 administrative efficiencies.  The commission must submit its
  7 31 plan, including proposed changes to the Code of Iowa and
  7 32 administrative rules needed to implement the plan, to the
  7 33 general assembly by January 15, 2007.  The general assembly
  7 34 may approve or reject the plan, but cannot amend or modify the
  7 35 plan.  If the general assembly and the governor approve the
  8  1 plan, it takes effect July 1, 2009.
  8  2    STUDENT ACHIEVEMENT AND TEACHER QUALITY PROGRAM.  The bill
  8  3 appropriates approximately $177.25 million in FY 2006=2007,
  8  4 and $327.25 million in FY 2007=2008 for the student
  8  5 achievement and teacher quality program.  Approximately $300
  8  6 million over the two=year period will be allocated to school
  8  7 districts and area education agencies for salaries and career
  8  8 development.
  8  9    STATE BOARD OF EDUCATION.  The bill requires the state
  8 10 board of education to adopt rules requiring school districts
  8 11 and accredited nonpublic schools to offer a core curriculum;
  8 12 to offer materials and support to school districts and schools
  8 13 designed to increase the number of students taking the
  8 14 American college testing, inc., college entrance examination;
  8 15 and to establish goals related to increasing the number of
  8 16 students taking the examination and to maintaining a statewide
  8 17 average score of 22 on the examination.
  8 18    STATE BOARD OF REGENTS == PERFORMANCE=BASED PROFICIENCIES
