  1 An Act relating to an appropriation to the department of
  2    education for purposes of allocating funds for technology that
  3    advances student achievement.

  1  1    Section 1.  DEPARTMENT OF EDUCATION.  There is appropriated
  1  2 from the general fund of the state to the department of
  1  3 education for the fiscal year beginning July 1, 2006, and
  1  4 ending June 30, 2007, the following amount, or so much thereof
  1  5 as is necessary, to be used for the purpose designated:
  1  6    For purposes of providing funds to school districts,
  1  7 students attending accredited nonpublic schools, and community
  1  8 colleges for technology that advances student achievement:
  1  9 ..................................................  $ 14,500,000
  1 10    1.  The moneys appropriated in this section shall be used
  1 11 for the purchase of technology that advances student
  1 12 achievement, subject to the restrictions of subsection 4.
  1 13    2.  The moneys appropriated in this section shall be
  1 14 allocated as follows:
  1 15    a.  The amount of $10 million shall be distributed to
  1 16 school districts in the proportion that the basic enrollment
  1 17 of a school district and the participating accredited
  1 18 nonpublic schools located within the school district for the
  1 19 budget year bears to the sum of the basic enrollments of all
  1 20 school districts and participating accredited nonpublic
  1 21 schools in the state for the budget year.  However, a district
  1 22 shall not receive less than $10,000 in a fiscal year except
  1 23 that the amount of moneys allocated to the institutions under
  1 24 the control of the department of human services as provided in
  1 25 section 218.1, subsections 1, 2, 3, and 5, shall be a total of
  1 26 not more than $20,000 to be distributed proportionately among
  1 27 the four institutions.
  1 28    b.  The amount of $3 million shall be distributed to
  1 29 community colleges to support community college vocational=
  1 30 technical technology improvement efforts.  The funds shall be
  1 31 distributed to the community colleges in a manner consistent
  1 32 with the formula established pursuant to section 260C.18C.
  1 33    c.  The amount of $1.5 million shall be distributed to
  1 34 school districts for the purchase of technology for accredited
  1 35 nonpublic schools as provided in subsection 5.
  2  1    3.  A participating accredited nonpublic school, the Iowa
  2  2 braille and sight saving school, the state school for the
  2  3 deaf, the Price laboratory school at the university of
  2  4 northern Iowa, and the department of human services on behalf
  2  5 of the institutions under the department's control as provided
  2  6 in section 218.1, subsections 1 through 3, 5, 7, and 8, shall
  2  7 certify their basic enrollments or average student yearly
  2  8 enrollment, as applicable, to the department of education by
  2  9 October 1, 2006.
  2 10    4.  A school district or community college shall expend
  2 11 funds received pursuant to this section for the acquisition,
  2 12 lease, lease=purchase, installation, and maintenance of
  2 13 instructional technology equipment, including hardware and
  2 14 software, materials and supplies related to instructional
  2 15 technology, and staff development and training related to
  2 16 instructional technology, and shall establish priorities for
  2 17 the use of the funds.  However, funds received pursuant to
  2 18 this section shall not be expended to add a full=time
  2 19 equivalent position or otherwise increase staffing unless the
  2 20 school district or community college expends not more than 10
  2 21 percent of the funds received to employ or enter into a
  2 22 contract with information technology specialists to provide
  2 23 technical consulting and integration of technology in
  2 24 curriculum and instruction to advance student achievement.
  2 25    5.  Technology adopted and purchased by a school district
  2 26 shall, to the extent funds are allocated pursuant to
  2 27 subsection 1, paragraph "c", be made available to students of
  2 28 accredited nonpublic schools located within the boundaries of
  2 29 the school district upon the written request of the
  2 30 authorities in charge of the accredited nonpublic school on
  2 31 behalf of the school's students as provided in this section.
  2 32 The department of education shall ascertain a maximum amount
  2 33 the school district shall be required to use for the purchase
  2 34 of technology for participating accredited nonpublic schools.
  2 35 The amount shall be in the proportion that the basic
  3  1 enrollment of a participating accredited nonpublic school
  3  2 bears to the sum of the basic enrollments of all participating
  3  3 accredited nonpublic schools in the state for the budget year.
  3  4 By October 15, 2006, the department of education shall notify
  3  5 the board of directors of each school district of the maximum
  3  6 amount of its allocation that shall be made available for
  3  7 purchasing nonsectarian, nonreligious technology for each of
  3  8 the participating accredited nonpublic schools located within
  3  9 the school district in accordance with this section.  For
  3 10 purposes of this section only, an accredited nonpublic
  3 11 school's enrollment count shall include only students who are
  3 12 residents of Iowa.
  3 13    The costs of providing technology to participating
  3 14 accredited nonpublic schools as provided in this section shall
  3 15 not be included in the computation of district cost under
  3 16 chapter 257, but shall be shown in the budget as an expense
  3 17 from miscellaneous income.  Technology expenditures made in
  3 18 accordance with this section shall be kept on file in the
  3 19 school district.
  3 20    6.  The department of education shall notify the department
  3 21 of revenue and finance of the amount to be paid to each school
  3 22 district and community college based upon the allocation
  3 23 criteria set forth for the appropriation pursuant to this
  3 24 section.  Allocations to each school district and community
  3 25 college under this section shall be made in one payment on or
  3 26 about October 15 and one payment on or about February 15 of
  3 27 the fiscal year in which the appropriation is made, taking
  3 28 into consideration the relative budget and cash position of
  3 29 the state resources.
  3 30    7.  Payments made to school districts and area education
  3 31 agencies under this section are miscellaneous income for
  3 32 purposes of chapter 257.  Moneys received under this section
  3 33 shall not be commingled with state aid payments made under
  3 34 sections 257.16 and 257.35 to a school district or area
  3 35 education agency and shall be accounted for by the local
  4  1 school district or area education agency separately from state
  4  2 aid payments.
  4  3    8.  Moneys received by a community college under this
  4  4 section shall not be commingled with general state financial
  4  5 aid, including financial aid to merged areas in lieu of
  4  6 personal property tax replacement payments, to merged areas as
  4  7 defined in section 260C.2, and including moneys received for
  4  8 vocational education programs in accordance with chapters 258
  4  9 and 260C.  Payments made to a community college shall be
  4 10 accounted for by the community college separately from other
  4 11 state aid payments.  Each community college shall maintain a
  4 12 separate listing within its budget accounting for payments
  4 13 received and expenditures made pursuant to this section.
  4 14 Moneys received under this section shall supplement, not
  4 15 supplant, the moneys each community college budgets for
  4 16 technology.  A community college may also use moneys received
  4 17 under this section for vertical infrastructure projects, as
  4 18 defined in section 8.57, subsection 6, paragraph "c", related
  4 19 to the acquisition or installation of technology.  A community
  4 20 college shall not be eligible for funds under this section
  4 21 unless the community college, without including moneys
  4 22 received under this section, maintains the same average amount
  4 23 of expenditures for technology per year as the community
  4 24 college maintains during the fiscal period beginning July 1,
  4 25 2003, and ending June 30, 2006.
  4 26    9.  For purposes of this section, "school district" means a
  4 27 school district, the Iowa braille and sight saving school, the
  4 28 state school for the deaf, the Price laboratory school at the
  4 29 university of northern Iowa, and the institutions under the
  4 30 control of the department of human services as provided in
  4 31 section 218.1, subsections 1 through 3, 5, 7, and 8.
  4 32                           EXPLANATION
  4 33    This bill appropriates $14.5 million from the general fund
  4 34 of the state to the department of education for purposes of
  4 35 allocating funds to school districts, students attending
  5  1 accredited nonpublic schools, and community colleges for
  5  2 technology that advances student achievement.
  5  3    The bill allocates $10 million to school districts to be
  5  4 distributed on a per pupil basis.  However, the bill defines
  5  5 "school district" to include the Iowa braille and sight saving
  5  6 school, the state school for the deaf, the Price laboratory
  5  7 school at the university of northern Iowa, and institutions
  5  8 under the control of the department of human services that
  5  9 serve children.  The bill provides that a district shall not
  5 10 receive less than $10,000 in a fiscal year except that $20,000
  5 11 is to be distributed proportionately between Glenwood and
  5 12 Woodward state resource centers, and the mental health
  5 13 institutes at Cherokee and Independence.
  5 14    The bill allocates $3 million to support community college
  5 15 vocational=technical technology improvement efforts.  The
  5 16 funds are to be distributed to the community colleges in a
  5 17 manner consistent with a formula established in Code.
  5 18    The amount of $1.5 million shall be distributed to school
  5 19 districts for the purchase of technology for accredited
  5 20 nonpublic schools.
  5 21    The technology funds received by a school district or
  5 22 community college are to be used for the acquisition, lease,
  5 23 lease=purchase, installation, and maintenance of instructional
  5 24 technology equipment, including hardware and software,
  5 25 materials and supplies related to instructional technology,
  5 26 and staff development and training related to instructional
  5 27 technology, and shall establish priorities for the use of the
  5 28 funds.  The funds shall not be expended to add a full=time
  5 29 equivalent position or otherwise increase staffing unless the
  5 30 school district or community college expends not more than 10
  5 31 percent of the funds to employ or enter into a contract with
  5 32 information technology specialists.
  5 33    The bill requires that technology adopted and purchased by
  5 34 a school district be made available to students of accredited
  5 35 nonpublic schools located within the boundaries of the school
  6  1 district.  The department of education is directed to
  6  2 ascertain a maximum amount a school district shall be required
  6  3 to use for the purchase of technology for participating
  6  4 accredited nonpublic schools.
