  1  1                           DIVISION I
  1  2   APPROPRIATIONS AND ALLOCATIONS FOR STUDENT ACHIEVEMENT AND
  1  3                     TEACHER QUALITY PROGRAM
  1  4    Section 1.  STUDENT ACHIEVEMENT AND TEACHER QUALITY
  1  5 PROGRAM.  There is appropriated from the general fund of the
  1  6 state to the department of education for the fiscal year
  1  7 beginning July 1, 2006, and ending June 30, 2007, the
  1  8 following amount, or so much thereof as is necessary, to be
  1  9 used for the purposes designated:
  1 10    For purposes, as provided in law, of the student
  1 11 achievement and teacher quality program established pursuant
  1 12 to chapter 284:
  1 13 .................................................. $130,000,000
  1 14    Sec. 2.  Section 284.13, subsection 1, paragraphs a through
  1 15 c, Code Supplement 2005, are amended to read as follows:
  1 16    a.  For the fiscal year beginning July 1, 2005 2006, and
  1 17 ending June 30, 2006 2007, to the department of education, the
  1 18 amount of two million dollars for the issuance of national
  1 19 board certification awards in accordance with section 256.44.
  1 20    b.  For the fiscal year beginning July 1, 2005 2006, and
  1 21 succeeding fiscal years, an amount up to four million two four
  1 22 hundred thousand dollars for first=year and second=year
  1 23 beginning teachers, to the department of education for
  1 24 distribution to school districts for purposes of the beginning
  1 25 teacher mentoring and induction programs.  A school district
  1 26 shall receive one thousand three hundred dollars per beginning
  1 27 teacher participating in the program.  If the funds
  1 28 appropriated for the program are insufficient to pay mentors
  1 29 and school districts as provided in this paragraph, the
  1 30 department shall prorate the amount distributed to school
  1 31 districts based upon the amount appropriated.  Moneys received
  1 32 by a school district pursuant to this paragraph shall be
  1 33 expended to provide each mentor with an award of five hundred
  1 34 dollars per semester, at a minimum, for participation in the
  1 35 school district's beginning teacher mentoring and induction
  2  1 program; to implement the plan; and to pay any applicable
  2  2 costs of the employer's share of contributions to federal
  2  3 social security and the Iowa public employees' retirement
  2  4 system or a pension and annuity retirement system established
  2  5 under chapter 294, for such amounts paid by the district.
  2  6    c.  For the fiscal year beginning July 1, 2005 2006, and
  2  7 ending June 30, 2006 2007, up to four six hundred eighty=five
  2  8 thousand dollars to the department of education for purposes
  2  9 of implementing the career development program requirements of
  2 10 section 284.6, the review panel requirements of section 284.9,
  2 11 and the evaluator training program in section 284.10.  From
  2 12 the moneys allocated to the department pursuant to this
  2 13 paragraph, not less than ten thousand dollars shall be
  2 14 distributed to the board of educational examiners for purposes
  2 15 of convening an educator licensing review working group.  From
  2 16 the moneys allocated to the department pursuant to this
  2 17 paragraph, not less than eighty=five thousand dollars shall be
  2 18 used to administer the ambassador to education position in
  2 19 accordance with section 256.45.  A portion of the funds
  2 20 allocated to the department for purposes of this paragraph may
  2 21 be used by the department for administrative purposes.
  2 22 Notwithstanding section 8.33, moneys allocated for purposes of
  2 23 this paragraph prior to July 1, 2004 2006, which remain
  2 24 unobligated or unexpended at the end of the fiscal year for
  2 25 which the moneys were appropriated, shall remain available for
  2 26 expenditure for the purposes for which they were allocated,
  2 27 for the fiscal year beginning July 1, 2004 2006, and ending
  2 28 June 30, 2005 2007.
  2 29    Sec. 3.  Section 284.13, subsection 1, paragraph d,
  2 30 unnumbered paragraph 1, Code Supplement 2005, is amended to
  2 31 read as follows:
  2 32    For each fiscal year in which funds are appropriated for
  2 33 purposes of this chapter, the moneys remaining after
  2 34 distribution as provided in paragraphs "a" through "c" and "e"
  2 35 "f" shall be allocated to school districts for salaries and
  3  1 career development in accordance with the following formula:
  3  2    Sec. 4.  Section 284.13, subsection 1, paragraph f, Code
  3  3 Supplement 2005, is amended to read as follows:
  3  4    f.  For the fiscal year beginning July 1, 2005 2006, and
  3  5 ending June 30, 2006 2007, up to ten million dollars to the
  3  6 department of education for use by school districts to add one
  3  7 additional teacher contract day to the school calendar.  The
  3  8 department shall distribute funds allocated for the purpose of
  3  9 this paragraph based on the average per diem contract salary
  3 10 for each district as reported to the department for the school
  3 11 year beginning July 1, 2004, multiplied by the total number of
  3 12 full=time equivalent teachers in the base year.  The
  3 13 department shall adjust each district's average per diem
  3 14 salary by the allowable growth rate established under section
  3 15 257.8 for the fiscal year beginning July 1, 2005 2006.  The
  3 16 contract salary amount shall be the amount paid for their
  3 17 regular responsibilities but shall not include pay for
  3 18 extracurricular activities.  A school district shall submit a
  3 19 report to the department in a manner determined by the
  3 20 department describing its use of the funds received under this
  3 21 paragraph.  The department shall submit a report on school
  3 22 district use of the moneys distributed pursuant to this
  3 23 paragraph to the chairpersons and ranking members of the house
  3 24 and senate standing committees on education, the joint
  3 25 appropriations subcommittee on education, and the legislative
  3 26 services agency not later than January 15, 2006 2007.
  3 27    Sec. 5.  Section 284.13, subsection 1, paragraph g, Code
  3 28 Supplement 2005, is amended by striking the paragraph.
  3 29                           DIVISION II
  3 30                 2005=2006 TECHNICAL CORRECTION
  3 31                STATE PROGRAM ALLOCATION FORMULA
  3 32    Sec. 6.  Section 284.13, subsection 1, paragraph d,
  3 33 unnumbered paragraph 1, Code Supplement 2005, is amended to
  3 34 read as follows:
  3 35    For each fiscal year in which funds are appropriated for
  4  1 purposes of this chapter, the moneys remaining after
  4  2 distribution as provided in paragraphs "a" through "c", "f",
  4  3 and "e" "g" shall be allocated to school districts for
  4  4 salaries and career development in accordance with the
  4  5 following formula:
  4  6    Sec. 7.  EFFECTIVE AND RETROACTIVE APPLICABILITY DATES.
  4  7 Section 5 of this Act, being deemed of immediate importance,
  4  8 takes effect upon enactment and applies retroactively to July
  4  9 1, 2005.
  4 10                           EXPLANATION
  4 11    This bill increases the appropriation from the general fund
  4 12 to the department of education for purposes of the student
  4 13 achievement and teacher quality program for FY 2006=2007 by
  4 14 approximately $60.4 million over the nearly $69.6 million
  4 15 appropriated for FY 2005=2006.  The statutory allocations for
  4 16 national board certification awards and the additional teacher
  4 17 contract day remain at the same level; the amount for
  4 18 mentoring and induction for beginning teachers is increased by
  4 19 $200,000; and the amount allocated for the career development
  4 20 program, the review panel, the evaluator training program, and
  4 21 the ambassador to education is increased by $115,000.  The
  4 22 moneys remaining, under the current statutory language, are
  4 23 allocated to school districts and area education agencies for
  4 24 salaries and career development.
  4 25    The bill makes a technical correction to the current Code
  4 26 language relating to the allocation of moneys to school
  4 27 districts for salaries and career development, and makes the
  4 28 provision effective upon enactment and retroactively
  4 29 applicable to July 1, 2005.
  4 30    The bill eliminates an obsolete provision.
