  1 An Act permitting public safety employees who receive an
  2    accidental disability retirement to become a member of the
  3    state's group insurance plan.

  1  1    Section 1.  NEW SECTION.  97A.14B  MEMBERSHIP IN STATE
  1  2 INSURANCE PLANS.
  1  3    1.  A member who is retired for an accidental disability
  1  4 under this chapter may elect to become a member of a state
  1  5 group insurance plan for employees of the state established
  1  6 under chapter 509A subject to the following conditions:
  1  7    a.  The member shall be eligible for all state group
  1  8 insurance plans on the basis of enrollment rules established
  1  9 for full=time state employees excluded from collective
  1 10 bargaining as provided in chapter 20.
  1 11    b.  The member shall pay the premium for the plan selected
  1 12 at the member's expense.
  1 13    c.  The premium rate shall be the same as the premium rate
  1 14 paid by the state and a state employee for the plan selected.
  1 15    d.  Program and coverage change selections shall be subject
  1 16 to the enrollment rules established for full=time state
  1 17 employees excluded from collective bargaining as provided in
  1 18 chapter 20.
  1 19    2.  The member shall remain eligible to be a member of a
  1 20 state group insurance plan pursuant to this section until the
  1 21 member no longer is eligible to receive a retirement allowance
  1 22 for an accidental disability or the member attains sixty=five
  1 23 years of age, whichever first occurs.
  1 24    3.  A member who elects to become a member of a state
  1 25 health or medical group insurance plan pursuant to this
  1 26 section shall be exempt from preexisting medical condition
  1 27 waiting periods.
  1 28    Sec. 2.  NEW SECTION.  97B.50B  MEMBERSHIP IN STATE
  1 29 INSURANCE PLANS FOR SPECIAL SERVICE MEMBERS.
  1 30    1.  A special service member who is retired for an in=
  1 31 service disability pursuant to section 97B.50A may elect to
  1 32 become a member of a state group insurance plan for employees
  1 33 of the state established under chapter 509A subject to the
  1 34 following conditions:
  1 35    a.  The special service member shall be eligible for all
  2  1 state group insurance plans on the basis of enrollment rules
  2  2 established for full=time state employees excluded from
  2  3 collective bargaining as provided in chapter 20.
  2  4    b.  The special service member shall pay the premium for
  2  5 the plan selected at the member's expense.
  2  6    c.  The premium rate shall be the same as the premium rate
  2  7 paid by the state and a state employee for the plan selected.
  2  8    d.  Program and coverage change selections shall be subject
  2  9 to the enrollment rules established for full=time state
  2 10 employees excluded from collective bargaining as provided in
  2 11 chapter 20.
  2 12    2.  The special service member shall remain eligible to be
  2 13 a member of a state group insurance plan pursuant to this
  2 14 section until the member no longer is eligible to receive a
  2 15 retirement allowance for an in=service disability or the
  2 16 member attains sixty=five years of age, whichever first
  2 17 occurs.
  2 18    3.  A special service member who elects to become a member
  2 19 of a state health or medical group insurance plan pursuant to
  2 20 this section shall be exempt from preexisting medical
  2 21 condition waiting periods.
  2 22    Sec. 3.  NEW SECTION.  411.15A  MEMBERSHIP IN STATE
  2 23 INSURANCE PLANS.
  2 24    1.  A member who is retired for an accidental disability
  2 25 under this chapter may elect to become a member of a state
  2 26 group insurance plan for employees of the state established
  2 27 under chapter 509A subject to the following conditions:
  2 28    a.  The member shall be eligible for all state group
  2 29 insurance plans on the basis of enrollment rules established
  2 30 for full=time state employees excluded from collective
  2 31 bargaining as provided in chapter 20.
  2 32    b.  The member shall pay the premium for the plan selected
  2 33 at the member's expense.
  2 34    c.  The premium rate shall be the same as the premium rate
  2 35 paid by the state and a state employee for the plan selected.
  3  1    d.  Program and coverage change selections shall be subject
  3  2 to the enrollment rules established for full=time state
  3  3 employees excluded from collective bargaining as provided in
  3  4 chapter 20.
  3  5    2.  The member shall remain eligible to be a member of a
  3  6 state group insurance plan pursuant to this section until the
  3  7 member no longer is eligible to receive a retirement allowance
  3  8 for an accidental disability or the member attains sixty=five
  3  9 years of age, whichever first occurs.
  3 10    3.  A member who elects to become a member of a state
  3 11 health or medical group insurance plan pursuant to this
  3 12 section shall be exempt from preexisting medical condition
  3 13 waiting periods.
  3 14                           EXPLANATION
  3 15    This bill provides that members of the Iowa department of
  3 16 public safety peace officers' retirement, accident, and
  3 17 disability system created in Code chapter 97A, the statewide
  3 18 fire and police retirement system established in Code chapter
  3 19 411, and special service members of the Iowa public employees'
  3 20 retirement system who receive a retirement allowance for a
  3 21 disability incurred in the line of duty under Code chapter 97B
  3 22 are eligible to become a member of the state group insurance
  3 23 plan.  The bill provides that the member remains eligible
  3 24 until the member no longer receives a disability retirement
  3 25 allowance or the member attains age 65, whichever first
  3 26 occurs.  The bill provides that the same plans available to
  3 27 noncontract state employees are available but that the member
  3 28 is required to pay the full premium cost of the plan selected.
  3 29 The bill also provides that the member electing coverage shall
  3 30 be exempt from preexisting medical condition waiting periods.
