  1  1    Section 1.  Section 321.261, subsections 2 and 3, Code
  1  2 2005, are amended to read as follows:
  1  3    2.  Any person failing to stop or to comply with the
  1  4 requirements in subsection 1 of this section, in the event of
  1  5 an accident resulting in an injury to any person is guilty
  1  6 upon conviction of a serious aggravated misdemeanor.
  1  7    3.  A person failing to stop or to comply with the
  1  8 requirements in subsection 1, in the event of an accident
  1  9 resulting in the death of a person, is guilty upon conviction
  1 10 of an aggravated misdemeanor a class "D" felony.
  1 11                           EXPLANATION
  1 12    This bill relates to the criminal offense of leaving the
  1 13 scene of a motor vehicle accident.
  1 14    The bill provides that a driver commits an aggravated
  1 15 misdemeanor if the driver involved in an accident causing
  1 16 injuries fails to stop and remain at the scene of that
  1 17 accident.  Current law provides that a driver commits a
  1 18 serious misdemeanor for such a violation.
  1 19    The bill also provides that a driver commits a class "D"
  1 20 felony if the driver involved in an accident causing the death
  1 21 of another fails to stop and remain at the scene of that
  1 22 accident.  Current law provides that a driver commits an
  1 23 aggravated misdemeanor for such a violation.
  1 24    A serious misdemeanor is punishable by confinement for no
  1 25 more than one year and a fine of at least $250 but not more
  1 26 than $1,500.  An aggravated misdemeanor is punishable by
  1 27 confinement for no more than two years and a fine of at least
  1 28 $500 but not more than $5,000.  A class "D" felony is
  1 29 punishable by confinement for no more than five years and a
  1 30 fine of at least $750 but not more than $7,500.
