  1  1    Section 1.  Section 285.11, Code 2005, is amended by adding
  1  2 the following new subsection:
  1  3    NEW SUBSECTION.  10.  At all times when a school bus is
  1  4 transporting pupils to or from school or to or from
  1  5 extracurricular activities sponsored by the school, there
  1  6 shall be at least one qualified employee or associate of the
  1  7 school aboard the bus in addition to the bus driver.
  1  8    Sec. 2.  IMPLEMENTATION OF ACT.  Section 25B.2, subsection
  1  9 3, shall not apply to this Act.
  1 10                           EXPLANATION
  1 11    This bill requires that whenever a school bus is being used
  1 12 to transport pupils to or from school or to or from school=
  1 13 sponsored extracurricular activities, there must be at least
  1 14 one qualified employee or associate of the school on board the
  1 15 bus, in addition to the bus driver.
  1 16    The bill may include a state mandate as defined in Code
  1 17 section 25B.3.  The bill makes inapplicable Code section
  1 18 25B.2, subsection 3, which would relieve a political
  1 19 subdivision from complying with a state mandate if funding for
  1 20 the cost of the state mandate is not provided or specified.
  1 21 Therefore, political subdivisions are required to comply with
  1 22 any state mandate included in the bill.
