  1  1    Section 1.  Section 481A.21, Code 2005, is amended to read
  1  2 as follows:
  1  3    481A.21  BIRDS AS TARGETS.
  1  4    1.  A person shall not keep or use any live pigeon or other
  1  5 bird as a target, to be shot at for amusement or as a test of
  1  6 skill in marksmanship, or shoot at a bird kept or used for
  1  7 such purpose, or be a party to such shooting, or lease any
  1  8 building, room, field, or premises, or knowingly permit the
  1  9 use thereof, for the purpose of such shooting except as
  1 10 otherwise provided in this section.
  1 11    2.  This section does not prevent any person from shooting
  1 12 at live pigeons, sparrows, and starlings when used in the
  1 13 training of hunting dogs.
  1 14    3.  This section does not prevent the commission from
  1 15 adopting rules under chapter 17A which allow hunting preserves
  1 16 to hold stationary or European=style bird hunts.
  1 17    Sec. 2.  Section 484B.4, Code 2005, is amended by adding
  1 18 the following new subsection:
  1 19    NEW SUBSECTION.  4.  a.  In addition, the department shall
  1 20 allow a person to make an application for a combined
  1 21 operator's license to operate a hunting preserve that meets
  1 22 the requirements of this chapter and of chapter 484C and is
  1 23 operated for the purposes specified in each of those chapters.
  1 24 The application for a combined operator's license shall be
  1 25 accompanied by a fee of five hundred fifty dollars.
  1 26    b.  Upon receipt of an application for a combined
  1 27 operator's license, the department or its authorized
  1 28 representative shall inspect the proposed hunting preserve and
  1 29 facilities described in the application.  If the department
  1 30 finds that the proposed hunting preserve meets all of the
  1 31 requirements of this chapter and of chapter 484C, the
  1 32 department may approve the application and issue a hunting
  1 33 preserve combined operator's license for the operation of the
  1 34 property and facilities described in the application with the
  1 35 rights and subject to the limitations in this chapter and
  2  1 chapter 484C and the rules adopted by the commission.
  2  2    c.  A hunting preserve combined operator's license expires
  2  3 on March 31 of each year.
  2  4    Sec. 3.  Section 484B.6, subsection 2, Code 2005, is
  2  5 amended to read as follows:
  2  6    2.  A minimum of five one hundred game birds shall be
  2  7 released during the hunting preserve season by each licensed
  2  8 hunting preserve authorized to release game birds.
  2  9    Sec. 4.  Section 484C.7, Code Supplement 2005, is amended
  2 10 to read as follows:
  2 11    484C.7  REGISTRATION AND FEE == COMBINED OPERATOR'S
  2 12 LICENSE.
  2 13    1.  A landowner who keeps preserve whitetail shall annually
  2 14 register the landowner's hunting preserve with the department
  2 15 by June 30.  The landowner shall pay the department a
  2 16 registration fee.  The amount of the registration fee shall
  2 17 not exceed three hundred fifty dollars per fiscal year.  The
  2 18 fee shall be deposited into the state fish and game protection
  2 19 fund.
  2 20    2.  In addition, the department shall allow a person to
  2 21 make an application for a combined operator's license to
  2 22 operate a hunting preserve that meets the requirements of this
  2 23 chapter and of chapter 484B and is operated for the purposes
  2 24 specified in each of those chapters as provided in section
  2 25 484B.4, subsection 4.
  2 26                           EXPLANATION
  2 27    This bill relates to hunting on hunting preserves.
  2 28    The bill allows the natural resource commission to adopt
  2 29 rules under Code chapter 17A which allow stationary or
  2 30 European=style bird hunts on hunting preserves.
  2 31    The bill requires the department of natural resources to
  2 32 allow a person to make an application for a combined
  2 33 operator's license to operate a hunting preserve that meets
  2 34 the requirements of Code chapters 484B and 484C for a fee of
  2 35 $550.  Upon receipt of an application for such a license, the
  3  1 department is required to inspect the proposed hunting
  3  2 preserve and facilities to ensure that all requirements of
  3  3 both chapters have been met.  A hunting preserve combined
  3  4 operator's license expires on March 31 of each year.
  3  5    A license to operate a hunting preserve under Code chapter
  3  6 484B for the purpose of hunting game birds and ungulates is
  3  7 still available for a fee of $200.  A registration to operate
  3  8 a hunting preserve under Code chapter 484C for the purpose of
  3  9 hunting preserve whitetail is still available for a fee of
  3 10 $350.
  3 11    The bill also provides that a hunting preserve licensed
  3 12 under Code chapter 484B may release a minimum of 100 instead
  3 13 of 500 game birds during each hunting preserve season.
