  1  1    Section 1.  Section 233B.1, subsection 2, Code Supplement
  1  2 2005, is amended to read as follows:
  1  3    2.  The Iowa juvenile home shall be maintained for the
  1  4 purpose of providing care, custody, and education of the
  1  5 children committed to the home.  The children committed to the
  1  6 home shall be limited to female wards of the state.  The
  1  7 children's education shall embrace instruction in the common
  1  8 school branches and in such other higher branches as may be
  1  9 practical and will enable the children to gain useful and
  1 10 self=sustaining employment.  The administrator and the
  1 11 superintendent of the home shall assist all discharged
  1 12 children in securing suitable homes and proper employment.
  1 13    Sec. 2.  Section 233B.3, unnumbered paragraph 1, Code 2005,
  1 14 is amended to read as follows:
  1 15    Admission to the home shall be granted to resident children
  1 16 of the state under who are female and less than seventeen
  1 17 years of age, as follows, giving preference in the following
  1 18 descending order named:
  1 19    Sec. 3.  Section 233B.5, Code 2005, is amended to read as
  1 20 follows:
  1 21    233B.5  TRANSFERS.
  1 22    The Subject to the admission criteria listed in section
  1 23 233B.3, the administrator may transfer to the home minor wards
  1 24 of the state from any institution under the administrator's
  1 25 charge or under the charge of any other administrator of the
  1 26 department of human services; but no person shall be so
  1 27 transferred who is.  However, a person with who has mental
  1 28 illness or mental retardation, or who is incorrigible, or has
  1 29 any vicious habits, or whose presence in the home would be
  1 30 inimical to the moral or physical welfare of the other
  1 31 children within the home shall not be transferred to the home,
  1 32 and any such child placed in the home may be transferred to
  1 33 the proper state institution.
  1 34    Sec. 4.  Section 233B.7, Code 2005, is amended to read as
  1 35 follows:
  2  1    233B.7  RULES.
  2  2    All children admitted or committed to the home shall be
  2  3 wards of the state and are subject to the admission criteria
  2  4 listed in section 233B.3 and the rules of the home.  Subject
  2  5 to the approval of the administrator, any child received under
  2  6 voluntary application may be expelled by the superintendent
  2  7 for disobedience and refusal to submit to proper discipline.
  2  8 Children shall be discharged upon arriving at attaining the
  2  9 age of eighteen years, or sooner if possessed of sufficient
  2 10 means to provide for themselves.
  2 11                           EXPLANATION
  2 12    This bill amends Code chapter 233B to restrict commitments
  2 13 at the Iowa juvenile home to female children.  The home is
  2 14 located in Toledo and is administered by the department of
  2 15 human services.
