1 An Act relating to adoption and termination of jurisdiction of a
2 court involving prior child support and custody proceedings.
3 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. NEW SECTION. 600B.31A TERMINATION OF
1 2 JURISDICTION OF COURT ISSUING ORIGINAL ORDER.
1 3 If a proceeding is initiated in a court for an adoption
1 4 involving the children of parents whose paternity, obligation
1 5 for support, or custody determination has been determined
1 6 under this chapter or for modification of a child support or
1 7 custody order granted under this chapter, the following
1 8 requirements shall be met if the proceedings are initiated in
1 9 a court other than the court which issued the original order:
1 10 1. The party initiating the proceedings shall present to
1 11 the court the names and addresses of the parties to the
1 12 original proceeding, if known, as well as the name and place
1 13 of the court which issued the original order and the date of
1 14 the original order.
1 15 2. The court in which the proceedings are initiated shall
1 16 cause notice of the proceedings to be served upon all the
1 17 parties to the original order unless the parties are deceased.
1 18 The court in which the proceedings are initiated or any
1 19 party to the proceedings may also request that a copy of the
1 20 transcript of the proceedings of the court which issued the
1 21 original order be made available for consideration in the new
1 22 proceedings.
1 23 EXPLANATION
1 24 This bill provides requirements for certain actions under
1 25 the paternity and obligation for support chapter, Code chapter
1 26 600B, that are initiated in a court other than the court which
1 27 issued the original order for paternity, child support, or
1 28 child custody. In a proceeding for adoption involving the
1 29 children of parents whose paternity, obligation for support,
1 30 or custody determination was determined under Code chapter
1 31 600B or for modification of a child support or custody order
1 32 granted under Code chapter 600B, the party initiating the
1 33 proceedings is required to present to the court the names and
1 34 addresses of the parties to the original proceeding, if known,
1 35 as well as the name and place of the court which issued the
2 1 original order and the date of the original order.
2 2 Additionally, the court in which the proceedings are initiated
2 3 is required to cause notice of the proceedings to be served
2 4 upon the parties to the original order unless the parties are
2 5 deceased. The court in which the proceedings are initiated or
2 6 any party to the proceedings may also request that a copy of
2 7 the transcript of the proceedings of the court which issued
2 8 the original order be made available for consideration in the
2 9 new proceedings.
