  1 An Act relating to notification of parents, guardians, or
  2    custodians of children receiving child care from an
  3    unregistered child care home when it is determined that child
  4    abuse involving the home has occurred.

  1  1    Section 1.  Section 237A.5, subsection 2, paragraph f, Code
  1  2 2005, is amended to read as follows:
  1  3    f.  If it has been determined that a child receiving child
  1  4 care from a child care facility or a child care home which
  1  5 receives public funding for providing child care is the victim
  1  6 of founded child abuse committed by an employee, license or
  1  7 registration holder, child care home provider, or resident of
  1  8 the child care facility or child care home for which a report
  1  9 is placed in the central registry pursuant to section 232.71D,
  1 10 the administrator shall provide notification at the time of
  1 11 the determination to the parents, guardians, and custodians of
  1 12 children receiving care from the child care facility or child
  1 13 care home.  A notification made under this paragraph shall
  1 14 identify the type of abuse but shall not identify the victim
  1 15 or perpetrator or circumstances of the founded abuse.
  1 16                           EXPLANATION
  1 17    This bill requires the department of human services to
  1 18 provide notification to parents, guardians, and custodians of
  1 19 children receiving child care from an unregistered child care
  1 20 home when it is determined that founded child abuse involving
  1 21 the child care home provider or resident of the child care
  1 22 home has occurred.  An unregistered child care home is limited
  1 23 to providing child care to not more than five children at any
  1 24 one time.  Under current law, the notification is not required
  1 25 unless the child care home receives public funding for
  1 26 providing child care.  The notification is required under
  1 27 current law for child care providers licensed or registered by
  1 28 the department.
