A BILL FOR
1 An Act requiring a "school license" motor vehicle sticker to be
2 displayed by an operator with a special minor's license and
3 providing penalties.
4 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:

1 1 Section 1. Section 321.194, Code 2005, is amended by
1 2 adding the following new subsection:
1 3 NEW SUBSECTION. 1A. A person who is licensed under this
1 4 section shall be issued a sticker to be affixed on the lower
1 5 left side of the rear window of the motor vehicle operated by
1 6 the licensee. The sticker shall be fluorescent yellow=green
1 7 in color, bear the words "school license", and bear an
1 8 identifying number determined by the department. A licensee
1 9 may be issued more than one sticker as determined by the
1 10 department by rule. A person who is licensed to drive under
1 11 this section shall not operate a motor vehicle that is not
1 12 clearly displaying the sticker required under this subsection.
1 13 Sec. 2. Section 321.194, subsection 2, Code 2005, is
1 14 amended to read as follows:
1 15 2. SUSPENSION, AND REVOCATION, AND CANCELLATION.
1 16 a. A driver's license issued under this section is subject
1 17 to suspension or revocation for the same reasons and in the
1 18 same manner as suspension or revocation of any other driver's
1 19 license. The department may also suspend a driver's license
1 20 issued under this section upon receiving satisfactory evidence
1 21 that the licensee has violated the restrictions of the license
1 22 or has been involved in one or more accidents chargeable to
1 23 the licensee. The department may suspend a driver's license
1 24 issued under this section upon receiving a record of the
1 25 licensee's conviction for one violation. The department shall
1 26 revoke the license upon receiving a record of conviction for
1 27 two or more violations of a law of this state or a city
1 28 ordinance regulating the operation of motor vehicles on
1 29 highways other than parking violations as defined in section
1 30 321.210. After a person licensed under this section receives
1 31 two or more convictions which require revocation of the
1 32 person's license under this section, the department shall not
1 33 grant an application for a new driver's license until the
1 34 expiration of one year.
1 35 b. The department shall immediately cancel a license
2 1 issued under this section upon receiving satisfactory evidence
2 2 that the licensee has violated the provisions of subsection
2 3 1A. A person whose license is canceled under this paragraph
2 4 shall not be issued another license under this section.
2 5 EXPLANATION
2 6 This bill requires that a motor vehicle operator who holds
2 7 a special minor's license must display a sticker on the lower
2 8 left side of the rear window of the vehicle. The sticker is
2 9 to be fluorescent yellow=green and bear the words "school
2 10 license" and an identifying number determined by the state
2 11 department of transportation. The department has the
2 12 discretion to issue more than one sticker to a licensee.
2 13 Current law provides that a special minor's license is
2 14 available, upon certification by school authorities of a
2 15 special need, to a person between 14 and 18 years of age to
2 16 drive to and from school and certain school activities within
2 17 the school district, provided the person has completed an
2 18 approved driver education course and does not have an
2 19 unsatisfactory driving record. The driver education
2 20 requirement may be waived if the department determines that it
2 21 would impose a hardship.
2 22 The bill requires the department to immediately cancel the
2 23 special minor's license of a person who operates a vehicle not
2 24 clearly displaying the school license sticker, and such person
2 25 shall not be issued another special minor's license.
