  1  1    Section 1.  Section 321.1, Code Supplement 2005, is amended
  1  2 by adding the following new subsection:
  1  3    NEW SUBSECTION.  7A.  "Cell phone" or "cellular telephone"
  1  4 means any device used for remote two=way communication
  1  5 including but not limited to a mobile telephone, two=way
  1  6 radio, wireless electronic mail device, or two=way pager.
  1  7    Sec. 2.  Section 805.8A, subsection 14, Code Supplement
  1  8 2005, is amended by adding the following new paragraph:
  1  9    NEW PARAGRAPH.  j.  CELL PHONE VIOLATIONS.  The scheduled
  1 10 fine for any moving traffic violation under chapter 321, as
  1 11 provided in this section, shall be tripled if the violation
  1 12 occurs while the motor vehicle operator is using a cell phone,
  1 13 as defined in section 321.1.
  1 14                           EXPLANATION
  1 15    This bill triples the scheduled fine for any moving traffic
  1 16 violation committed while the motor vehicle operator is using
  1 17 a cell phone.  The bill includes any device used for remote
  1 18 two=way communication within the definition of "cell phone"
  1 19 for purposes of the regulation of motor vehicles under Code
  1 20 chapter 321.
