1 1 Section 1. Section 728.7, Code 2005, is amended to read as

1 3 728.7 EXEMPTIONS FOR PUBLIC LIBRARIES AND EDUCATIONAL
1 4 INSTITUTIONS.
1 5 Nothing in this This chapter prohibits does not prohibit
1 6 the use of appropriate nonobscene material for educational
1 7 purposes in any accredited school, or any public library, or
1 8 in any educational program in which the minor is

1 12 public library if the minor has parental consent to attend the

1 15 public library as long as the minor has parental consent to
1 16 have access to "R" rated movies at the library and has
1 17 parental consent to access the internet through a computer
1 18 without a filter that protects minors from visual depictions
1 19 of obscene material.
1 20 EXPLANATION
1 21 This bill relates to the use of material by minors for
1 22 educational purposes at any school or library and the
1 23 attendance of minors at exhibitions or displays of art work.
1 24 The bill provides that nonobscene material may be used for
1 25 educational purposes in any school, or public library, or any
1 26 educational program in which a minor is participating.
1 27 Current law provides only that appropriate material may be
1 28 used for educational purposes at such institutions.
1 29 The bill also provides that a minor may attend an
1 30 exhibition or display of art works if the minor has parental
1 31 consent to attend the exhibition or art display.
1 32 The bill also provides that a minor may have access to any
1 33 material at a public library if the minor has parental consent
1 34 to access "R" rated movies or to use the internet without a
1 35 filter.
2 1 "Material", "obscene material", and "minor" are defined in
2 2 Code section 728.1.
